In January of 2019, the Falmouth Select Board voted not to operate either Wind 1 or Wind 2 again in Falmouth. The Massachusetts courts in multiple rulings June of 2017 two years ago the turbines are a nuisance and shut them down.

The Select Board the same night board unanimously voted to direct Town Manager and Town Counsel to prepare three requests for proposals (RFPs).

Six months later there have been letters sent out but no Request for Proposals. The town continues to spend money on engineering firms and attorneys to prepare Request For Proposals.

Falmouth officials said months ago that nine organizations responded to the Town of Falmouth’s "request for letters of interest" to move its two wind turbines out of town.

The public has not seen any of the correspondence as to the town does not disclose bad news about the two town-owned wind turbines.

The Town of Falmouth knew prior to construction before 2010 that the turbines would break state noise laws based on a 2005 KEMA Inc map showing the turbines would affect up to 99 residential homes for just one turbine.

The town also received a written letter ;

The documentation of the 110 decibels of noise shows the town created a substantial and specific danger to public health or safety related to the implementation or use of ARRA, American Recovery and Reinvestment Act, covered funds with its second wind turbine.

The Town has previously been provided with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances.
