PLYMOUTH, MA — The attorney for Duxbury mom Lindsay Clancy has moved for the case that she murdered her three young children to be dismissed and to investigate the lone juror who would not acquit her, according to reports.
"The motion from the lawyer, Kevin Reddington, dated on Friday, asks the judge, William Sullivan, to examine the juror's mobile phone metadata during the time that the jury was deliberating over whether Ms. Clancy should be found guilty of murdering her three children," a New York Times story said.
Clancy, 36, was charged with the January 2023 murders of 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.
"Prosecutors have said that in January 2023, Clancy intentionally strangled the three children with fitness bands in their Massachusetts home before jumping out of a second-floor window," the BBC reported. "Clancy, now 36, was paralysed by the jump and has attended the trial in a wheelchair."
"Clancy has admitted that she killed her children in 2023. However, her attorney, Kevin Reddington, claims her mental state was so impaired by postpartum mental illness that she shouldn't be held criminally responsible for their deaths," according to WBUR.
Sullivan declared a mistrial Sept. 4.
The motion filed Friday "says a retrial would violate Clancy's double jeopardy rights, since the claims shared with the judge "required a judicial inquiry sufficient to ascertain whether her right to an impartial jury was being violated," NBC reported.
"Eleven of 12 jurors were ready to clear Clancy of criminal responsibility, with the majority feeling that she was in the grip of a rare condition called postpartum psychosis when she strangled her kids," according to the Guardian. "But one juror, Michael Desronvil, sided with the prosecutors, who had argued that Clancy knew what she was doing."
