Lindsay Clancy Triple Murder Jury Deliberates For 6th Day As Mistrial Looms

PLYMOUTH, MA — The Lindsay Clancy triple murder jury returned for a sixth day of deliberation.

The jury has already told Judge William Sullivan twice that it cannot come to a unanimous decision in the case.

Sullivan has responded by reading them the Tuey-Rodriguez instruction, also known as the "dynamite charge."

"Boston attorney Peter Elikann said the Tuey-Rodriguez charge is 'known colloquially as the dynamite charge … And it really pushes the jury and urges them to try to work out a unanimous decision,'" according to a New York Post story.

Retired Massachusetts Judge Jim Barretto explained to WCVB that the Tuey-Rodriguez instruction "alerts the jury to, among other things, the seriousness of the obligation and unique qualifications to decide this case."

Clancy, 36, is charged with the January 2023 murders of 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.

"Prosecutors have said that in January 2023, Clancy intentionally strangled the three children with fitness bands in their Massachusetts home before jumping out of a second-floor window," the BBC reported. "Clancy, now 36, was paralysed by the jump and has attended the trial in a wheelchair."

"Clancy's attorneys do not dispute that she killed the children," according to PBS. "But they say she should not be held criminally responsible because she was mentally ill, believing she heard voices ordering her to take their lives and her own."
