Man Charged with Stealing Dead Woman's Phone Pleads Not Guilty
The Brockton man allegedly pocketed the woman's phone after she was fatally hit by a train Thursday night at Boston's Downtown Crossing.

The 26-year-old Brockton man charged with pocketing a dead woman’s cell phone after she was struck by a train Thursday night at Boston’s Downtown Crossing Station pleaded not guilty Monday to a larceny charge.
Josue Gonzaelez was arrainged in Boston Municipal Court and released on personal recognizance, according to CBS Boston. His attorney said there was “no criminal intent,” according to the report.

Gonzalez turned himself in to MBTA Transit Police Friday night after police released photos of him in the act earlier in the day.
According to police, the woman’s phone became dislodged when she was hit by the Red Line train and landed on the subway platform. In surveillance footage, Gonzalez can be seen stepping on the phone to conceal it, police said. He then looks around to see if anyone is watching, pockets the phone and casually walks away, according to police.

No foul play is suspected in the woman’s death.
