“This defendant is alleged to have been driving erratically and irresponsibly, with a blood alcohol level nearly three times the legal limit,” District Attorney Leone said. “We allege that the defendant was driving extremely negligently, resulting in the death of a young woman. Our thoughts remain with the victim’s family.”

According to authorities, on July 9, 2010, at approximately 9:10 p.m., Somerville Police responded to Mystic Avenue at Route 28 south for reports of a single motorcycle crash. Upon arrival police observed the victim lying on a center median. She was unresponsive and had significant visible injuries.

Officers also observed the defendant allegedly walking his motorcycle away from the scene of the crash. The victim and the defendant were both immediately transported to Massachusetts General Hospital. The victim was pronounced dead shortly after she arrived at the hospital.

Massachusetts State Police reconstruction team immediately began an investigation into the circumstances of the crash. Authorities allege that the defendant was operating the motorcycle with the victim in the passenger’s seat behind him. It is alleged that the defendant ran a red light on Route 28 near Wellington circle and proceeded to travel at a high rate of speed while weaving between traffic lanes.

Authorities allege that the defendant then cutoff an oil tanker on Route 28 south near Interstate 93 south and subsequently struck a center median. The collision with the median resulted in the victim being thrown from the motorcycle. A subsequent analysis of the defendant’s blood alcohol level determined that it was nearly three times over the legal limit. Court records indicate that the defendant was operating on a suspended license that was suspended for drug related matters.

These charges are allegations and the defendant is presumed innocent until proven guilty.

The prosecutor assigned to this case is Assistant District Attorney Corey Santos. The victim witness advocates are Nadia Guevara and Daniela Bianco.
