Concord Man Arrested On Multiple Child Rape Charges

A multi-month investigation by police led to Wayne Felong facing 4 sexual assault charges including 3 aggravated felonious assault counts.

CONCORD, NH — A Concord man is facing felony rape charges involving a child after a multi-month investigation of an incident from earlier this year.

On March 5, a woman from Farmington contacted police about a sexual assault accusation made by a girl against Wayne M. Felong, 41, with a last known address of Loudon Road in Concord. The case was referred later to Concord police due to jurisdictional reasons, according to an affidavit.

The woman said the girl told her about an incident at the Salisbury Green apartment complex in late February in which Felong sexually assaulted her while on the phone with a woman, the report stated.

The girl was interviewed by an advocacy center in Strafford County and, according to the report, was hesitant about revealing specifics. Felong was then interviewed by Concord detectives. He told them “he was advised by an attorney not to speak to the police” but “was not represented by a particular attorney,” an affidavit stated.

“Wayne told detectives that if there was a warrant, to contact him and he would turn himself in,” the affidavit stated.

On April 5, Felong was contacted again and he denied the assault allegation, a detective reported.

The victim was examined and interviewed with a detective writing they believed the allegations to be true based on the demeanor of both Felong and the girl, the affidavit said. However, the investigation was suspended.

But about a month later, detectives began reinvestigating and spoke to the woman who forwarded the original claim. The report stated she had notes and writings by the victim. Interview info also stated the victim denied being inappropriately touched but also disclosed one incident, the report stated.

Detectives filed a preservation letter to Felong’s cellphone service provider while also requesting a one-party recording authorization with the New Hampshire Attorney General’s Office which was approved. The woman reporting the incident called Felong, while police were listening, and requested he at least apologize to the victim.

“In regards to a criminal case, I cannot speak on it,” Felong was accused in the report of saying during the call.

In late June and late July, grand jury subpoenas were requested for Felong’s text messages and call logs. The affidavit stated, on the day Felong was accused of the sexual assault, he was involved in a 45-minute call, just as the woman had described to detectives. The call was with another woman, the report stated.

Detectives also learned the victim had told two friends about the assault. Those friends were interviewed. The affidavit stated the friends said the victim accused Felong of putting something in her juice that made her tired, the report stated.

The victim also wrote more notes and posted a video on TikTok about the incident — miming a song that appeared to describe something happening in a room when no one else was around.

Detectives learned the state was now involved in investigating the incident and other family members were trying to get to the bottom of what happened.

The affidavit accused Felong of admitting to one family member previously that he “had a problem looking at young girls” and was battling depression. In one incident, Felong was seated at a kitchen table, looking at his phone, and the witness reported seeing pictures of young girls that he was looking at, the affidavit stated. Another family, however, did not mention the prior conversation with Felong during an interview with Concord detectives and said she did not want to take sides in the incident.

Detectives applied for another one-party recording in order to meet with the woman who was suspected of being on the call with Felong during the alleged rape incident. The woman, however, refused to answer any questions “and used the same statement that Wayne made” about not speaking without an attorney present.

More interviews were performed with family members about the incident and Felong while the victim was brought to an interview with the Merrimack County Advocacy Center in Concord. During that interview on Aug. 27, she “made a full disclosure of being sexually assaulted by Wayne,” the affidavit stated.

A warrant was issued against Felong on Aug. 30 and he was arrested on Sept. 3 on two felony counts of aggravated felonious sexual assault-victim under 13. He was arraigned later that day. According to superior court records, the charges were revised to two counts of aggravated felonious sexual assault-domestic violence-intoxicating substance, a single aggravated felonious sexual assault-domestic violence-victim under 13 charge, and felonious sexual assault-domestic violence-victim under 13 charge, all felonies. He is due back in Merrimack County Superior Court on Dec. 10 for a dispositional conference hearing.

According to superior court records, Felong pleaded guilty to a felony second-degree assault charge out of Manchester in August 2000.
