Brian C. Silfies, 43, of Midland Street in Concord, was arrested at 8:15 p.m. on July 24, for driving while intoxicated, reckless operation, racing on highways, basic speed, and failure to present license. Officers were sent to a motor vehicle crash at Dakin and Pillsbury streets involving a BMW Series 7 that smashed into a tree. The vehicle, according to police, pushed the tree right out of the ground. A second officer spoke to a witness who alleged that when she was leaving the parking lot of a Pillsbury Street building, the driver of the BMW, later identified as Silfies, allegedly “asked her to race him.” According to the report, she declined and he allegedly asked her again. She stated no again and asked to be left alone. She started her car and Silfies allegedly “peeled out of the lot onto Dakin St. and as he got onto Dakin St. he was going way too fast and lost control and hit a tree on the sidewalk across from the VNA then kept going,” according to the report. The vehicle reportedly stopped in the middle of Pillsbury Street after hitting the tree. The reporting officer spoke with Silfies and he allegedly smelled like alcohol, and had pupils that were small and eyes that were red. “Silfies was leaning on one of the cruisers while I was talking with him,” the officer alleged. Silfies agreed to a field sobriety test and then was arrested. “While I was transporting Silfies to headquarters he had several severe mood swings to include laughing, crying, anger and pleading with me to not arrest him,” the officer alleged. Later, the officer alleged, he said, “I should not have been driving and you did the right thing arresting me.” He’s due in court on Aug. 10.
