Felon Faces Knife Possession, Threat Charges After Incident In Concord: Follow-Up

CONCORD, NH — A felon living in a rooming house on North Spring Street is facing threat and weapon charges after an incident on North Spring Street on Saturday.

Just after 11:15 a.m., Concord police were sent to the area of Warren and North Spring streets for a report of a disturbance and possible shooting. A man in his 50s who was riding a bike in the area claimed a man dressed entirely in black threatened him with a knife and shot at him. The complainant said the suspect entered a rooming house on North Spring Street between Warren and Pleasant streets. An officer on the way to the scene confirmed hearing gunfire, according to scanner chatter and an affidavit.

When the first officer arrived, they met up with a man in his late 50s, and a struggle ensued in the back parking lot of the building. The man, who was later found not involved in the case, was handcuffed. Another man in his late 30s, who was seen exiting the rooming house, was also detained and escorted to a police cruiser for officer safety. A third man, identified later as Ryan Kyle Moreira, 41, of North Spring Street in Concord, was also detained. An officer, during a pat down, found a knife in Moreira’s pocket, an affidavit stated.

The building was also evacuated.

Officers spoke with the victim, who was known due to numerous police contacts. He said he was riding his bike when a vehicle backed up into his bike, but he was not injured. The victim and Moreira “began to exchange words,” and he “yelled at the operator” who just struck the bike, the report said. The victim claimed Moreira brandished the knife with a “threatening demeanor” and stated, “Wanna f------ go?,” an affidavit stated.

The victim told police Moreira did not threaten to kill him, but they continued to exchange words, the report said. The victim accused Moreira of walking away and entering the rooming house, and he called the police and gave them a description of the man and the vehicle. The victim said Moreira was seen from a window of the building and he told him the cops were on their way, the affidavit said. When he began walking back to his bike, the complainant heard a “pop pop” sound, which he believed to be gunfire.

“(The man) stated he ‘never had someone shoot at him before but knew they were real gunshots’,” the affidavit said.

The victim did not see anyone with a gun, and when he looked at the building, he did not see the man in the window either, the report said. Police arrived shortly after, and the victim identified Moreira as the threat suspect, the officer wrote.

The complainant was taken to police headquarters for a statement. Pictures were also taken of the bike, which had other scrapes and damage not affiliated with the incident.

During an interview at headquarters, the victim stated he did not know what was happening or if he was going to get stabbed.

“Anything can possibly happen,” he stated later.

The report said the victim showed where he was and where the suspect was on a map.

A detective was called to the scene, and police were at the rooming house for several hours on Saturday.

The report stated the detective interviewed Moreira, who said he had been living at the rooming house for about a year and a half. He drove by the man on the bike and claimed he was being yelled at in front of the rooming house, the report said. Moreira said, to avoid a confrontation, he did not roll the window of the car down, the affidavit said.

After parking, Moreira claimed the victim confronted him again, stating, “Oh, you live here, huh?,” the detective wrote. He claimed the victim appeared to be reaching into his jacket, so he confronted him and then went inside, the affidavit said. Moreira said he never met or seen the man before, the affidavit said.

When asked if Moreira had any weapons at the time, “There was a long pause,” the detective wrote. He was accused of responding and saying, “Yea, I did,” while confirming he had a knife. When asked if he displayed the knife during the confrontation, Moreira said he wanted to talk to a lawyer, the affidavit said, and the detective ended the interview.

Moreira is a felon due to a willful discharge of a firearm in a grossly negligent manner conviction out of California Superior Court in San Bernadino from October 2013, the report said. He was arrested on criminal threatening-deadly weapon and felon in possession of a dangerous weapon charges, both felonies, and held on preventative detention. Moreira was video arraigned in Concord District Court on Monday and released on personal recognizance.

A probable cause hearing is set for April 8.
