Man From Manchester Gets Off Light In 2023 Concord Statutory Rape, Computer Services Case: Follow-Up
Francois Niyibigira received 2 12-month and 1 suspended sentence on disorderly conduct charges. Must register as a sex offender for 5 years.

CONCORD, NH — A man from Manchester accused of repeatedly sexually assaulting a girl under 16 in October and November 2023 pleaded guilty to lesser charges, leading to only 12 months in jail and five years registering as a sex offender.
Francois Niyibigira, 29, of Manchester, pleaded guilty to three disorderly conduct charges on Jan. 13, according to Merrimack County Superior Court records. He received two 12-month jail sentences, served consecutively, and one 12-month sentence, suspended for three years, with three years of probation after release. Niyibigira is also required to obtain treatment and/or attend educational programs. After being released, he will be monitored by probation and must register as a sex offender, since the court found the disorderly conduct offenses qualified for sex offender registration.
Originally, Niyibigira was charged with certain uses of computer services prohibited, indecent exposure-sex act with a child under 16, and two felonious sexual assault-penetration-victim 13 to 15 charges, all felonies, as well as a sexual assault misdemeanor charge in February 2024 after being accused of getting caught with the partially unclothed girl, 15, in the back of a car with New York registration at Rolfe Park in Penacook in November 2023.

The victim in the case was interviewed, and police began investigating her social media accounts and acquired other evidence before bringing forward charges. Later in the investigation, according to a court affidavit, it was revealed the girl was diagnosed with a sexually transmitted disease a few weeks after the Rolfe Park incident.
Niyibigira was indicted on the four felony charges in April 2024 and arraigned in June 2024.

According to filings, the case appeared to get bogged down from there.
Motions to continue, motions to determine competency, and motions to seal records were granted. In late November 2024, Niyibigira’s public defender filed a motion to dismiss the case, but it was denied a few days later. A second evaluation was then requested and granted in early 2025. This, despite Niyibigira’s ability to drive and function in other ways, since he was arrested by Concord police in March 2025 on an operating without a license charge and an unregistered vehicle violation while driving in the capital city.
In April 2025, a motion to have a state expert’s report on competency was sealed. A status conference was held a month later. More services and requests for competency were requested and sealed for several months.
Sometime in late November and early January, a plea deal was reached.
According to superior court records and posts online, Niyibigira was accused of felony riot in Durham in September 2016 when he was 20. After six months of court dates, the charge was nolle prossed. He was also arrested on a disorderly conduct charge in September 2016 in Durham, according to Foster’s Daily Democrat.
In February 2021, Niyibigira was accused of conspiracy to commit felony falsifying physical evidence in Manchester. In March 2021, he was charged with two more evidence felonies. He was indicted on the first charge 14 months later, while a grand jury indicted him on the second set of charges in July and October 2021. After 10 months of hearings, the first charge was nolle prossed. The other two charges were nolle prossed two months later.
New Hampshire State Police also arrested Niyibigira on a reckless operation charge in Londonderry on Jan. 21, 2024.
