Motorcycle Crash Leads To DWI, Felon Possessing Gun Charges In Concord

CONCORD, NH — A man from the Lakes Region is facing charges after crashing his motorcycle in Concord in November.

Around 5:30 p.m. on Nov. 19, fire and rescue teams, as well as police, were sent to a motorcycle crash with injury on Regional Drive near Minute Way. A sheriff’s deputy also arrived to assist. A firefighter was driving by when they were flagged down by a woman on the side of the road, telling them about the accident.

Zachary P. Rivet, 33, of Doris Drive in Gilford, the rider, was checked for injuries and assisted by EMTs. During this process, an officer wrote in an affidavit, Rivet was accused of possessing a Glock 17. Rivet requested a firefighter put the gun in his motorcycle saddlebag. But the report said the firefighter could not place the gun in the bag due to the motorcycle's condition after the crash.

Rivet attempted to reach for the gun, but the firefighter secured it and gave it to the sheriff’s deputy, an affidavit stated, who secured it in his vehicle.

“(The firefighter) said that Zachary had disclosed that he knew he should not have the firearm as he is a felon,” the report said.

Rivet was taken to Concord Hospital and, at 8:19 p.m., was charged with driving while intoxicated.

The officer checked and found Rivet was a felon due to a burglary conviction in Belknap County in December 2008. A warrant was issued against him for felon in possession of a dangerous weapon charge, a felony. Rivet was arrested again at 1:30 p.m. on Nov. 25.

According to superior court records, Rivet was accused of burglary in Laconia and Tilton in April 2008. One charge was dismissed while he pleaded guilty to the other. In August 2008, Rivet was charged with felony theft by unauthorized taking in Tilton. He pleaded guilty to the charge in December 2008.

In October 2010, he was found in violation of probation on the burglary conviction. About a month later, Rivet was charged with habitual offender after an incident in Allenstown from July 2010. The charge, however, was dropped in March 2011. In January 2014, he was charged with habitual offender again, after an incident in Sanbornton in November 2013. That charge was nolle prossed in May 2014, according to court records.

A violation of court order hearing in the case was held in February 2016.

Rivet was released on bail Dec. 5 and was arraigned in Merrimack County Superior Court on Dec. 15. He is due back in court for a dispositional conference on April 20, 2023.
