Judge Flushes Bergen Man's Toilet Paper Lawsuit Against Costco: Report

Robert Arnold filed suit after claiming the wholesaler charged him sales tax on toilet paper twice in 2015.

A judge dismissed a Bergen County man's lawsuit against Costco claiming that the wholesaler charged him sales tax on toilet paper twice in 2015.

Robert Arnold of Leonia sued Costco after two of its stores — one in Wayne, the other in Hackensack — violated state law by charging him the tax, NJ.com reported.

Arnold's 2016 lawsuit claimed Costco violated several state statutes, including the New Jersey Consumer Protection Act, according to the report.

Costco's attorneys argued that the suit should have been thrown out because New Jersey has a remedy in place for consumers to recover improperly collected sales tax and that Arnold refused to follow that remedy, according to the report.

U.S. District Judge William H. Wallis dismissed the lawsuit with prejudice March 20, the report said.
