Police Didn't Enforce Court Order 1 Day Before Child Died: UPDATE

The child's father and village police went to the child's home Friday, but the mother refused to give up custody.

MAMARONECK, NY — The lawyer of the father of Gabriella Boyd, the 2-year-old who died Saturday after police shot her mother, said Mamaroneck village police refused to carry out a family court order. The court order was for the father — Stephen Boyd — to take custody of his daughter.

Stephen Boyd and the police went to the house where Gabriella lived with her mother, Cynthia Arce, 28, and grandmother, but Arce refused to give them the child and shut the door, abc7ny.com said.

The Westchester County District Attorney’s office said it would not comment because the case is under investigation.

MAMARONECK, NY — A post on Facebook by the Mamaroneck PBA said that the shooting of a 28-year-old woman Saturday liked saved lives, though the woman’s daughter, who was found injured, later died. The PBA said the mother attacked the officers “with a knife in each hand, injuring two officers.”

After the use of a stun gun failed, “[a]nother officer was forced to shoot the woman, who will survive, saving the other officers from imminent severe injury and or death,” the PBA said.

A White Plains attorney, Martin Rosen, who is the 2-year-old’s father’s client in a custody dispute, confirmed to lohud.com that the girl’s name is Gabrielle Maria Boyd. Her mother’s name is Cynthia Arce.

The incident took place on Chestnut Avenue in Mamaroneck.

Police said they arrived at the residence after 1:30 pm. April 28 and found the injured child.

As they tried to help her, police said, Arce attacked them.

Four officers were injured and taken to the hospital with non-life-threatening injuries.
