Mount Vernon Police Sergeant Accused Of Assaulting Woman

DUTCHESS COUNTY, NY — A Mount Vernon police sergeant was accused of physically assaulting a Mount Vernon woman in September. Westchester County District Attorney Anthony A. Scarpino Jr. said Thursday that Martin Bailey, 49, of Dutchess County, was arrested and arraigned on a multi-count indictment.

He was charged with the following:

• Tampering with physical evidence, a felony
• Criminal obstruction of breathing or blood circulation, a misdemeanor
• Third-degree assault, a misdemeanor
• Second-degree harassment, a violation

Bailey was released on his own recognizance and is scheduled to appear in court again Nov. 26.

Prosecutors said, on Sept. 21, Bailey, who was not on duty as a police sergeant, got into a physical altercation with a woman in a private home he owns in Mount Vernon.

During the assault, he choked her, police said. He is also charged with harassing the woman.

Later, during the investigation, Bailey presented a mobile audio recording of the Sept. 21 incident claiming his innocence, prosecutors said.

A forensic investigation revealed that Bailey had tampered with the audio by altering portions of it.
