Mister Softee Wins the Battle of the Jingle

Mister Softee took rival New York Ice Cream to court for stealing its jingle.

NEW YORK CITY, NY — When you come at Mister Softee, you best not miss.

A Brooklyn Federal Court judge ruled in favor of Mister Softee in a lawsuit in which the o.g. of the ice cream truck business sued rival New York Ice Cream for stealing the Softee jingle, The New York Daily News reported Monday.

Magistrate Judge Steven Gold also ruled that New York Ice Cream, operated by former Softee franchisee Dimitrios Konstantakakos, must pay Mr. Softee $10,000 for legal fees and other costs, according to The Daily News.

"This is a victory in our ongoing cases against those who violated their franchise agreements and continued to use Mister Softee's registered marks," Mister Softee lawyer Frederic Jennings told The Daily News.
