Plea Entered in Peekskill Sunday Shooting

PEEKSKILL, NY — Janiel Myke pleaded guilty Monday to one count of Manslaughter in the First Degree, a class “B” Violent Felony, in the shooting death of Stephen Agosto on Dec. 20, 2015.

Myke shot Agosto three times with a stolen 9mm handgun in front of 1431 Park Street in Peekskill at 10:20 p.m. that night, Acting Westchester County District Attorney James A. McCarty said in his announcement.

Agosto was taken to a local area hospital where he was later pronounced dead. An autopsy conducted by the Medical Examiner’s office revealed that Agosto suffered a fatal bullet wound to the head and a bullet wound to each of his legs.

An intensive investigation by the Peekskill Police resulted in the 26-year-old's arrest just two days later. Myke was identified as a suspect and his home on Rolling Way in Peekskill was placed under surveillance, and when he was seen leaving he was taken into custody after a brief pursuit Dec. 22, 2015.

It was determined that Agosto and Myke had had a long-standing dispute, the DA said.

Myke remains in jail. He will be sentenced on Nov. 29. He faces a maximum of 25 years in state prison.

Assistant District Attorney Heide Mason of the Superior Court Trial Division is prosecuting the case.
