Pleasantville Court: Robbery Defendant Seeks Treatment; Multiple DWI Cases Heard

Adjournment for DWI Defendant Who Allegedly Left Scene of Accident
Glenn McCallen, 41, appeared in court to answer to charges including a first offense DWI with a BAC of more than 0.08, breath test violation, imprudent speed, leaving the scene of an accident and other vehicle and traffic infractions.

after allegedly running a red light at the Grant Street intersection of the Saw Mill River Parkway, hitting another car and fleeing the scene.
On Tuesday, Assistant District Attorney Nicholas DiCostanzo said he was prepared to prosecute, while McCallen's attorney asked for a four-week adjournment to give him time to speak with the District Attorney's office.

The defendant surrendered his driver's license to the court and the case was adjourned until July 12 at the defendant's request.
Teen Robbery Defendant Seeks Treatment, Case Adjourned
Pleasantville residents Paul Gregory and Daniel Sullivan, both 17, appeared in court to answer to charges relating to a May 14 incident in which they allegedly threatened two Briarcliff Manor teens with a knife and demanded money in front of the Shell gas station on Manville Road. .
On Tuesday, DiCostanzo said he had spoken with the defendants' lawyers about offering a "straight SCI" in the cases, but both refuted the offer.
One of the attorneys stated he has investigated the case and found there are "possible factual considerations here that must be addressed," which may challenge "whether it actually constitutes robbery."
Sullivan's attorney said his client plans to attend a six-week treatment program, which could interfere with his ability to appear at possible future adjournment dates.
"It is very important to my client and his parents that he complete this program," he stated.
"Make sure we get the report," said Village Justice John Curley.
The cases were adjourned until July 12 at the defendants' request, and while Gregory's attorney said he will be present, Sullivan's appearance has been waived.
DWI Defendant has Been Convicted Before
Kimberly Pufky, 30, is charged with a felony DWI resulting from a June 5 arrest.
The Pleasantville resident has been previously convicted of DWI.
She also is accused of refusing to take a chemical breath test when pulled over this month.
On Tuesday, DiCostanzo recommended Pufky be referred to Treatment Alternatives for Safer Communities (TASC) for treatment, but her attorney suggested an alternate treatment evaluation, which Curley said was acceptable to the court.
DiCostanzo said the current offer for Pufky is an SCI felony hearing.
The matter was adjourned until July 26 at the request of the defendant.
First Appearance for Woman Who Allegedly Shoplifted, Left Feces
Eileen Gaughan, 30, was arrested on May 24 for Petit Larceny from .
The following day, Gaughan allegedly returned to Key Food, though she was ordered to stay off premise, and left behind a bag of feces.
She was re-arrested on May 25 for Criminal Tampering, Criminal Nuisance in the Second Degree and Criminal Trespassing in the Third Degree.
According to DiCostanzo, the Yorktown Heights resident is currently on probation in both Mount Kisco and Yorktown, and will likely be charged with a Violation of Probation in both municipalities.
He added there may be a future global disposition in the matter and the case was adjourned until July 12.
Fine, Conditional Discharge for Woman Who Purchased Alcohol for Minor
Heather Bull, 23, was arrested on January 16 and charged with Unlawful Dealing with a Child.
The Pleasantville resident allegedly purchased alcohol for a 13-year-old at the on Bedford Road at approximately 7:30 in the evening.
On Tuesday, Bull pleaded guilty as charged and was sentenced to a one-year conditional discharge and $400 in fines and surcharges.
"You should know better," Curley warned as the case concluded.
Marijuana Case Adjourned
Andrew Torpie, 39, was arrested on Sept. 23, 2010 and subsequently charged with growing cannabis without a license and the unlawful possession of marijuana.
The Pleasantville resident's attorney asked for a two-week adjournment on Tuesday, but Torpie cut him off and said he wouldn't be able to make the date.
Curley advised Torpie to speak through his attorney, who stated he would contact the court if the date needed to be changed.
The case was adjourned to July 12 at the defendant's request.
Larceny Case Resolved
Amanda Egloff, 23, was arrested on April 8 after her Washington Avenue employer allegedly videotaped her stealing cash from her purse.
According to , Egloff had been stolen from the purse on three separate occasions while it was at the office. The woman, who reported the incident on April 6, stated she set up a hidden camera during the last incident and observed Egloff taking cash from the purse.
On Tuesday, Egloff pleaded guilty to the reduced charge of Disorderly Conduct and was sentenced to a one-year conditional discharge and paid $100 in restitution.
OTHER CASES
- Henry Abraham, 51, was arrested on May 27 after a Lincoln Avenue property owner reported he was trying to break down the door to his former apartment. The Millwood resident allegedly admitted to the crime and was arrested and subsequently charged with Criminal Mischief in the Fourth Degree. On Tuesday, the case was adjourned until July 12.
- David Cross, 57, is charged with a first offense DWI and lane violation resulting from a May 14 arrest. The Chappaqua man's case was put over until June 28 for control.
- Joseph Locurto, 22, of New Windsor, was charged with Criminal Possession of a Controlled Substance in the Seventh Degree after he for allegedly possessing two bags of cocaine. On Tuesday, Locurto pleaded guilty to Disorerly Conduct and was sentenced to a one-year conditional discharge and $200 in fines and surcharges.
