Pleasantville Man Charged with Christmas DWI

A Pleasantville man was charged with two drunk driving counts stemming from a Christmas Day vehicle collision in Chappaqua, according to New Castle Police.
Javier Garcia Lucena, 49, is accused by police of driving a 1990 Ford Ranger pickup truck near the Route 117/Roaring Brook Road intersection, and then striking a pole after leaving the road itself. Police then allege that Lucena's vehicle struck a 2010 BMW.
Police responded to the scene of the alleged collision between the vehicles, and claim that he "showed signs of being intoxicated." Lucena was given a blood alcohol test, which came back at a .21 blood alcohol content (BAC) level. He was then charged with a count of driving while intoxicated (DWI), along with a count of aggravated DWI. The later charge is because a BAC above .18 was detected, according to police.

The defendant, who police said was then treated for an arm injury at Northern Westchester Hospital in Mount Kisco, is due to appear in New Castle Justice Court on Jan. 24, 2013.
The alleged incident is the second of its kind in New Castle during the holiday season. This past Saturday (Dec. 22), an Ossining man was charged with DWI after his vehicle allegedly struck a guard rail in Millwood.
