Teen Refuses To Leave Kmart, Gets Arrested: PD
Police said the 16-year-old had previously been banned from the store.
YORKTOWN, NY — A teenager was charged with juvenile delinquency, police said, because he refused to leave a store from which he had previously been banned. Yorktown police said the unnamed Somers 16-year-old would have been charged with obstructing government administration and resisting arrest, misdemeanors, and trespass, a violation, had he been an adult.
Police said, around 7 p.m. Oct. 6, a report was received about a man in Kmart who refusing to leave the premises. He had previously been barred from the store by Kmart employees, police said.
An investigation by officers found the teen stayed in the store, at 355 Downing Drive, after being asked to leave numerous times by Kmart employees.

Police said the 16-year-old also refused police commands to leave the store, and fought with them and resisted arrest.
After being arrested, the teen was issued a juvenile appearance ticket and is due to appear in the Westchester County Department of Probation Oct. 15.
