IT IS STILL SUMMERTIME, one more holiday to go, and is usually everybody’s signal to party. This is when a lot of calls come in and the new client on the other end of the phone is in need of serious help because of one (or more) too many. Naturally, the best way to avoid this absolute nightmare, and the possible frightening consequences of an accident or injury, is to positively refrain from even a drop of alcoholic beverage before you get behind the wheel. It is staggering to the imagination how little it actually takes to push you over the legal limit.
Even if you are not beyond the legal boundaries, the smallest amount still puts the aroma of alcohol on your breath and if that is detected, you are subjected to the ordeal of field tests, and the unintended visit to the police station, the breathalyzer exam, or blood alcohol tests in the hospital, and the delay and humiliation that comes with being detained.
Whatever you do, remember that refusing the breath or chemical tests is a separate offense in itself and can lead to a license suspension even if you are later found to be not guilty of DUI itself. Remember that a conviction in one state is generally transferred to any other state which subscribes to the Interstate Contact and often results in a suspension in your own state.
If you do have the misfortune to be arrested for DUI, call us right away. An experienced attorney is essential and your rights and defenses will be protected. Be cooperative with, and polite to, the arresting officer.
AND do not be afraid to tell your parents, and hope that it will simply go away. Your parents can be affected financially and their insurance prejudiced by what you do in their car, or the one they bought or lent you that they paid for. Better to incur their disfavor then to cause them permanent legal consequences.
Also remember that if you injure or take the life of someone while you are under the influence, you could be looking at a prison sentence, and the ruination of your many hopes and aspirations.
DO NOT TRY TO ELUDE A POLICE OFFICER, or leave the scene of an accident, no matter how scared you are.
