Lyft Passenger From Holland Killed In DUI Crash: Police

A Holland man who was riding as a Lyft passenger was hit and killed by a drunk driver late last month in Bensalem, police said.

A Canadian man has been charged in connection with a fatal crash that killed a Lyft passenger from Holland late last month.

Shane M. Learn, 48, of Toronto, is charged with homicide by vehicle while DUI, homicide by vehicle and aggravated assault by vehicle while DUI. Two others were injured in the April 28 in Bensalem that killed Neil W. Weiner, 57.

Weiner’s wife, Audrey Shapiro, 55, remains hospitalized. The couple’s Lyft driver, identified as Daniel Weingart, suffered minor injuries, the affidavit said.

Police allege that Learn was driving a 2014 Ford F-150 truck northbound on Richlieu Road around 6:45 p.m.when he left his travel lane and struck a guardrail. The truck then crossed the double-yellow center line into the northbound lane and struck a 2018 Chevrolet Malibu driven by Weingart, the affidavit said.

Police smelled alcohol on Learn’s breath, and his eyes were bloodshot, glassy and watery, the affidavit said.
He failed two field sobriety tests and then took a portable breath test, which registered a .162 percent blood alcohol concentration, the affidavit said.

He was arraigned before Magisterial District Judge Michael W. Gallagher, who set bail at $300,000, 10 percent cash. A preliminary hearing is tentatively scheduled for May 16.

The case is being investigated by the Bensalem Township Police Department, and is being prosecuted by Deputy District Attorney Robert D. James, Chief of the Homicide by Vehicle Division.
