Witness Places Holley at Scene of Capital Murder

Prosecutors said a witness saw Holley running from the scene of the shooting, throw a gun into a dumpster.

HOUSTON, TX -- An eye-witness to the shooting death of a 42-year old man in September has identified Chad Holley as the man responsible for the murder.

Holley, who appeared in court on Tuesday, is accused of shooting David Trejo-Gonzalez to death during an armed robbery on Sept. 21.

Prosecutors in the case said a witness allegedly saw Holley running from the scene and toss a gun into a dumpster.

According to prosecutors, the witnessed also alleged that Holley told him that he'd just shot someone because of drug money he owed and reportedly asked the witness to be his alibi he was questioned by police.

Police said that Trejo-Gonzalez was walking from his car to his apartment in the 100 block of East Crosstimbers on Sept. 21, when he was stopped by Holley who demanded his money.

In the course of the robbery, Holley allegedly shot Trejo-Gonzalez to death, and fled the area in a low-rider style white pickup that was driven by someone else.

Holley became the center of national headlines in 2010, when a video surfaced that showed the then-15-year juvenile being beaten by several Houston police officers who'd chased Holley during a burglary call.

Community Activist Quanell X, who represented Holley during that brutality case, dismissed the witness claims as unreliable and said that Holley was wearing a court-ordered ankle monitor at the time and likely was carrying his cell phone.

“All they’ve got to do is check the ankle monitor, and the GPS location will determine whether he was there or not,” he said.

According to a KPRC report, the witness also picked Philip Battles out of the lineup and claimed that Battles and Holley were together the night Trejo-Gonzalez was murdered.

Battles has since been charged with the capital murder of 4-year old Ava Castillo, who was killed during an armed robbery on Nov. 14.

Holley is being held at the Harris County Jail.
