Age Discrimination Alive and Well in the Workforce!

Preparations are underway to take luxury food retail giant, Balducci's Food Lovers Market to court in a lawsuit based on an age and disability discrimination complaint filed with the Equal Employment Opportunity Commission (EEOC) by former employer Henri R. Caudron, age 83, of Arlington, Virginia.

Mr. Caudron worked at the McLean, Virginia Balducci store as a meat cutter until his firing in February of 2018. He was a well-known and beloved figure in the store where he had worked for 21 years until forced out of his job due to his age and knee disability. Previously he was a reputable and respected French chef in the Washington, DC area for over three decades, and the owner of a French restaurant, La Brochette on M Street, NW in the late 70's.

In July of 2018, the American Association of Retired People (AARP) stated: "More than a
quarter million Americans 85 or older were employed over the past year — almost twice the comparable number shortly before the Great Recession — according to an analysis of census figures by the Washington Post. The newspaper reported that the 255,000 85-plus workers who have been employed in the past year represent 4.4 percent of their age group. The rate in 2006 was 2.6 percent. The Post’s Wonkblog cites several reasons for the job spike for older adults: longer life expectancy,concerns about retirement income, better education and less physically demanding work."

Past decisions by the US Supreme Court have ruled in favor of corporations over individual seniors seeking redress for age discrimination in the workplace and have impacted decisions in lower courts. Age discrimination is the one form of bias that everyone regardless of education, background, gender or race is subjected to across all occupations and industries even though the ADEA (Age Discrimination in Employment Act ) celebrated its 50th anniversary in 2018.

Baby Boomers range in age from 54-72, Generation X'ers are now in their early 50's and in 2016 Millennials surpassed the Baby Boomers to form the largest working force in the labor market. Tick, tock!

My goal in bringing this lawsuit is to send a clear message to all employers: jobs are not just for young people! Just because you reach a certain age doesn't make you unemployable. It doesn't take a crystal ball to see that after age 50 many people will run up against a brick wall trying to find or hold onto their job. The ADEA needs a reboot!” stated Mr. Caudron.

Funds are currently being raised to cover expenses for Henri R. Caudron's legal defense in preparation for a court battle with the food giant, owned by KB Holding, Inc, and affiliated with GSSG Capital, one of the largest private sector companies in Qatar with offices in New
York, Europe, and the Middle East.
