Lake Forest Driver Charged In Fatal Hit And Run, Cyclist ID'd

An Aliso Viejo father died after being struck Orange County Sheriff's Departments arrested the suspect after he fled his vehicle, they say.

LAKE FOREST, CA —A south Orange County man riding on Westridge Drive at Woods Canyon Drive was struck and killed by a hit and run motorist Wednesday, police said. The driver was identified as Rogelio Martinez Cuin, a Lake Forest resident, who was charged with felony hit and run, Friday, the Orange County Sheriff's Department reported.

Martinez-Cuin's charges include single counts each of gross vehicular manslaughter and hit-and-run with permanent and serious injury, both felonies, as well as a misdemeanor count of driving on a suspended or revoked license due to a DUI, according to court records. Martinez-Cuin is also facing a sentencing enhancement for fleeing the scene of a vehicular manslaughter.

Michael David Tomlinson, 50, rode his electric bike to work every day, CBS2 reported. He was frequently seen by commuters, according to CBS2 reports. Tomlinson typically dressed in bright clothes with proper reflective lights on his bike, a local bike store owner told reporters.

Tomlinson was crossing Woods Canyon Drive when the Volvo struck him, Carrie Braun of the Orange County Sheriff's Department said.

"The driver kept going, but witnesses gave deputies a vehicle description," she said. "Police found the vehicle about a mile away, and deputies arrested the suspected driver a short distance from the Volvo."

A witness rendered first aid at the scene and Tomlinson was then rushed by ambulance to a hospital, where he died, CBS2 reported. Tomlinson is survived by his wife of 20 years, a son who is in high school and a daughter who is returning home from college.
