Cloverdale Man Charged With Murder and More In Deadly 'Pot House' Shootout

Another alleged accomplice is still in hospital. Two men from the home face a slew of charges, as well.

One of three suspects allegedly involved in a deadly shoot-out during an alleged attempted marijuana-related home invasion robbery in Santa Rosa Monday was arraigned Wednesday afternoon in Sonoma County Superior Court.

Miguel Flores Jr., 37, of Cloverdale, was charged with murder, conspiracy, attempted robbery with a firearm, residential burglary and discharging a firearm into an inhabited dwelling.

One of Flores’ alleged accomplices died from wounds suffered in the shoot-out, and California law states a person may be charged with murder if a wrongful death, including the death of an alleged accomplice, occurs during the commission of a felony crime.

Flores pleaded not guilty but did no give up his right to have a preliminary hearing within 10 days. His next court hearing is scheduled for Friday morning.

Santa Rosa police said Flores, Fidencio Bocanegra Reyes, 24, and Pablo Reyes-Martinez, 22, both of Santa Rosa, went to the residence around 12:49 a.m.

During an exchange of gunfire with Manuel Garcia, 25, the occupant of the house, Reyes-Martinez and Reyes were wounded, according to police.

Sgt. Dave Linscomb said at least six to eight shots were exchanged between by the intruders and from inside the home within a distance of 15 feet. The three men fled in a vehicle that was found around 1:40 a.m. Monday in the parking lot of Kaiser Permanente Medical Center in Santa Rosa, police said.

They refused orders by Sonoma County sheriff’s deputies to get out of the car until deputies fired chemical agents into the vehicle, Santa Rosa police said. Reyes-Martinez was found dead and Reyes was taken to Santa Rosa Memorial Hospital with life-threatening injuries, police said. An update on his condition was not available Wednesday afternoon.

During the attempted robbery and shoot-out investigation, police found marijuana and other drugs in two structures on the property and two children under 8 years old living in 25-year-old Manuel Garcia’s house, where the shootout occurred, Linscomb said.

Garcia and Rolando Ramirez-Ruiz, 23, of Santa Rosa, were charged with manufacturing concentrated cannabis, conspiracy, possession of marijuana for sale, possession of a controlled dangerous substance, possession of cocaine, and maintaining a house containing controlled substances.

Four of the counts include firearms enhancements. Garcia also was charged with two counts of child endangerment.

Neither defendant was charged with murder. They did not enter pleas and a hearing on their $1 million bail is scheduled for Monday afternoon in Sonoma County Superior Court.
