NEW CANAAN, CT — The Connecticut Supreme Court this week denied a request by Michelle Troconis to obtain transcripts from the bitter divorce and custody battle between Jennifer and Fotis Dulos, the Hartford Courant reported.

Troconis is facing a charge of conspiracy to commit murder in the disappearance of Jennifer Dulos, who vanished from her New Canaan home on May 24, 2019, and is presumed to be dead. Dulos' body has not been found.

Attorney Jon Schoenhorn, who represents Troconis, sought the transcripts to possibly help with the defense of his client. Troconis is the former girlfriend of the late Fotis Dulos, and is accused of helping him in a murder plot. She is free on bond, and is scheduled to appear in Stamford Superior Court on Wednesday in the criminal case.

Based on blood evidence found at the New Canaan house and other factors, Fotis Dulos was charged with kidnapping and murdering his estranged wife. He never stood trial, however, because he took his own life in January 2020.

In addition to Troconis, Kent Mawhinney, a former friend of Fotis, has also been charged with conspiracy to commit murder in the case, and awaits trial. Both Troconis and Mawhinney have pleaded not guilty.

Schoenhorn was seeking to have the divorce and custody documents unsealed, but the state Supreme Court ruled unanimously that the decision to seal the transcripts could not be overruled while the original court still has jurisdiction over the case, according to the Courant.

In Wednesday's hearing, Schoenhorn is expected to argue why previously seized items should be returned to Troconis, such as cell phones and other electronic devices, and evidence from some searches should be suppressed.

Troconis, Schoenhorn claims, was subjected to an illegal body search, and anything obtained from it should be suppressed.

Additionally, Schoenhorn continues to seek a change in venue in the case to Hartford County, where Troconis and Fotis Dulos were arrested, and where much of the evidence in the case was discovered.
