Trump Lawyer Expected To Seek Case Dismissal In GA Court: Report

Per a media report, Attorney Steve Sadow will appear Friday in a Fulton Co. court on behalf of Donald J. Trump, who is facing RICO charges.

ATLANTA — Former President Donald Trump's attorney Steve Sadow was expected Friday to request the dismissal of racketeering charges against his client in Fulton County Superior Court, Atlanta News First reported.

Accused of attempting to overturn the 2020 presidential election results in Georgia alongside 18 co-defendants, Trump faces a slew of charges relating to election interference.

Sadow was expected to argue Trump acted under free speech, protected by the nation's First Amendment, the news outlet reported.

“Here, the indictment’s recitation of supposedly ‘false’ statements and facts, undisputed solely for purposes of a First Amendment-based general demurrer/motion to dismiss, show that the prosecution of President Trump is premised on content-based core political speech and expressive conduct protected by the First Amendment,” Sadow wrote in a Monday court filing, per the outlet.

Trump surrendered to the Fulton County Jail on Aug. 24 and became the first former president to have a mugshot taken.


He was charged on suspicion of violation of the Racketeer Influenced and Corrupt Organizations Act, three counts of solicitation of violation of oath by public officer, conspiracy to commit impersonating a public officer, two counts of first-degree conspiracy to commit forgery, two counts of conspiracy to commit false statements and writings, conspiracy to commit filing false documents, filing false documents and false statements and writings. He was released on a pre-arranged $200,000 bond.

Notable defendants in the widespread election interference case include former White House Chief of Staff Mark Meadows, former New York Mayor Rudy Giuliani, Georgia Sen. Shawn Still and former attorneys Kenneth Chesebro and Sidney Powell.

An official trial date has not yet been set for Trump though Fulton County District Attorney is asking for the trial to start on Aug. 5, 2024, Atlanta News First reported.
