Nizzear Rodriguez, 13, was shot hours after celebrating his birthday

Carrollton Police have in custody a 17-year-old who is charged in the fatal shooting of a 13-year-old in Carroll County.
Carrollton Police say Malik Davis is charged in the death of Nizzear Rodriguez, who was shot to death inside his apartment Sunday. His body was found by an uncle; the boy suffered a bullet wound to his head, CBS 46 reported.
Rodriguez had celebrated his 13th birthday Saturday, according to media reports. He was allegedly shot while he slept.

Police said Rodriguez may not have been the intended target, and are looking into the possibility that there is a second suspect.
Davis reportedly turned himself into police at the urging of his mother.

Davis has been charged with murder, burglary and carrying a weapon during a crime. He is being charged as an adult.
Carrollton police Capt. Chris Dodd told the Atlanta Journal-Constitution, investigators are “not ruling out” that the shooting was a case of mistaken identity and “that they just went into the wrong apartment looking for another individual.”
WSB-TV reported Rodriguez was a student at Carrollton Junior School, which had grief counselors at the school Monday. He was an eighth-grader.
