Jury Takes Only an Hour to Convict Man of Sexual Battery of Minor Family Member

A Douglas County jury needed about an hour to convict a Douglasville man this week for sexual battery and contributing to the delinquency of a minor involving a family member in 2013.

Douglas County Solicitor General Matthew Krull said Phillip Charles McCarty, 45, was sentenced to two years in prison, the maximum amount of time allowable by law for the offense.

Krull said in a news release that McCarty was accused of inappropriate touching the family member and giving her alcohol while she visited his home in the summer of 2013.

“These are the sort of facts we rarely see in State Court,” said Chief Assistant Solicitor David Holmes, who prosecuted the case. “This was a heinous crime committed against a young girl by a figure in her life she loved and trusted. …

“At the end of the day, a predator has been taken off the streets, and hopefully the victim and her family will be able to rest a little easier moving forward.”

The girl’s age at the time of the incident was not revealed in the news release.

The jury took a little over an hour to reach a verdict in the two-day trial, which included testimony from the victim.

“These types of cases are difficult for victims to relive the details in front of a courtroom full of strangers,” Krull added. “It was very moving to see this young lady have the strength and courage to face her attacker in court. I am also proud of the way in which Mr. Holmes and my employees handled this case.”
