Apex 400 Lawsuit Continued In Glen Ellyn
The pending lawsuit has stalled the project, which will occupy the former Giesche Shoes site, for the time being.
GLEN ELLYN, IL — Construction on Glen Ellyn's Apex 400 project, which will replace the former Giesche Shoes site, remains on hold after an ongoing lawsuit against the development has been continued until April 16, 2020. The news of the continuance comes after a status hearing that was held Wednesday on the matter.
The next step will be to hear a motion to dismiss from the Village of Glen Ellyn and GSP Development, LLC, who is helming the project. The $40 million Apex 400 project will feature 107 luxury apartments, more than 8,800 square feet of commercial space, and a two-story parking garage.
Apex 400 got the green light in April 2019, despite ongoing protests from preservationists and residents who were hoping to save the Giesche Shoes building. The building was demolished in August 2019 after a motion to stop the demolition that was filed by the group Citizens for Glen Ellyn Preservation was denied.

According to Glen Ellyn officials, the building was able to be demolished because it was on privately owned property and a demolition permit, but no stop work order, had been issued. In September, a judge granted 10 to 12 motions to dismiss multiple lawsuits against GSP from Schoub Properties, Anne and Jonathan Brazier and Citizens for Glen Ellyn Preservation.
Once construction on Apex 400 starts again, it's estimated the project will take 380 days to complete.
