Lawsuits Against Glen Ellyn's Apex 400 Dismissed By Judge
The judge reportedly granted 10 of 12 motions to dismiss multiple suits against the developers.

GLEN ELLYN, IL — The ongoing battle to prevent the Apex 400 development from moving forward may be at an end after a judge dismissed multiple lawsuits against the project. The developers faced ongoing lawsuits from Schoub Properties, Anne and Jonathan Brazier and Citizens for Glen Ellyn Preservation, which were recently heard in hearings on Sept. 18 and Sept. 23.
According to an update from village officials, it was determined that Citizens For Glen Ellyn Preservation "has not demonstrated it has standing to sue under any of the claims asserted in the Amended Complaint.
The judge ruled, for instance, that all claims related to the former site of Giesche shoes, which was demolished in August to make way for Apex 400, are "moot." It was also ruled that a public hearing was not necessary to approve the transfer of a village parking lot to the Apex 400 developers.

The five-story Apex 400 development will also include more than 100 luxury apartments, over 8,800 square feet of commercial space, and "no net loss" of parking spaces for the village, officials said.
The development will feature a two-story parking garage with one floor dedicated to public parking.

Village officials are hoping the development will increase housing diversity, give a boost to downtown business, and provide tax revenue to support other capital projects.
