It was the second DUI for the Olympian, who was 19 years old when he received the first, near Salisbury University on the Eastern Shore. He received probation before judgment at the time, The Baltimore Sun reported.

Upon being placed on probation in 2014, Phelps was ordered to stay clean and sober during his 18-month probationary period, and he also had to attend self-help groups for 72 weeks, according to TMZ Sports.

Phelps was penalized in the pool too; USA Swimming suspended him for approximately six months.

Now, he's busy training for the Olympics and has been spending time with Boomer Robert Phelps, the first child for the champion swimmer and fiancée Nicole Johnson; their baby was born on May 5.

On Father's Day, Phelps recorded a roughly 30-minute video providing a window into his new life as a dad. He and Johnson are living in Arizona as he trains for the Olympics in Rio de Janeiro this August.

This week he will be in Omaha for the Olympic trials.

Phelps said he plans to stay sober until after the Olympics, according to E!
