Medford Bank Property Owner Docked $10K
MassDEP said the owner of the Citizens Bank property on Cabot Road violated requirements.
MEDFORD, MA – The owner of the Citizens Bank property on Cabot Road was penalized $10,000 by the Massachusetts Department of Environmental Protection for conducting cleanup activities last year at the formerly contaminated site.
Lexington Savings Corp., LLC was fined for being in direct violation of an Activity and Use Limitation (on the property at 20 Cabot Rd. The property had undergone a cleanup of oil and hazardous materials that concluded in 1999.
While commercial and industrial use of the property is allowed, Lexington Savings Corp. did not provide a complete plan or obtain MassDEP approval before some of the more intrusive work at the property, namely pumping 600 gallons of water from an excavation and excavating and stockpiling on site 65 cubic yards of soil since Aug. 17, 2016. “A deed restriction like this is in place on the future activity at a site and it is there for a reason, and that is to protect health and safety,” said Eric Worrall, director of MassDEP’s Northeast Regional Office in Wilmington. “In this case, it’s unacceptable that the proper protections and regulations in force were not followed.”
Lexington Savings Corp. will pay $7,500 of the penalty and the remaining $2,500 will be suspended provided all terms of the consent order are met.
