Allenstown Man Violates Protective Order Again: Cops

Concord Police: Wayne Hicks allegedly IM'd his ex on Facebook and IM'd her again while police were taking a complaint from her.

A local man was arrested for a third time during the last few years for violating a protective order.

Wayne A. Hicks, 31, of Betty Lane in Allenstown, was arrested at 4:31 p.m. on Oct. 15, 2015, for violation of a protective order.

Officers were sent to the Steeplegate Mall to speak to a woman about an allegation that her ex – Hicks – had contacted her the day before on Facebook, an alleged violation of a protective order she had against Hicks, according to a court affidavit. She was outside of Concord at the time of the incident and reported it to another police department, too, but wanted Concord Police to know.

“While looking through the messages sent to (the woman) by Hicks, I realized that it appeared that the messages were coming from Hicks and that (she) was ignoring Hicks’ messages,” the officer reported, while taking photos of the messages.

While speaking with the woman about the case, Hicks allegedly instant messaged her again.

“if you want to chat gota mess me here phone dead till tomm heard got job hope going good awesome :-) I love to see everyone but if not I understand Love u guys much ill be till I hear from u,” according to the report.

The officer advised the woman how to respond and what to write in an exchange, including finding out his current location, in order to establish probable cause that he was allegedly committing a crime in Concord. The officer also advised her to suggest a possible meeting location – a Dunkin’ Donuts location, where they later arrested him.

According to a court affidavit, Hicks reportedly told officers he thought she was going to drop the protective order. He allegedly pointed to messages from her that he had. The woman wrote, “Dropping order just leave me alone, stop going on my accounts all I do is work and be with MY SON. TAKE CARE,” according to the report.

Hicks reportedly texted back about the situation and the woman replied back, “Bye,” with another request for her family to be left alone.

Hicks was held without bail.

During the past few years, Hicks has been arrested for simple assault, criminal threatening, DWI, habitual offender, violation of a protective order, and warrants, according to police reports.
