Mark K. Morgan, 45, of South State Street in Concord, was arrested at 9:45 p.m. on Dec. 31, 2015, and charged with disorderly conduct and resisting arrest. Also arrested was Rachel L. Hamilton, 51, of South State Street in Concord, for disorderly conduct, resisting arrest or detention, and simple assault. Officers were sent to the area of Concord and Jefferson streets for two intoxicated individuals in the road. The caller reported that the man was down and couldn’t seem to get off the ground while the woman attempted to assist but didn’t seem to be in any condition to really help, according to court affidavits. When the first officer arrived, he saw the man in the middle of the street. “From my initial contact neither party was able to speak clearly or stand up on their own,” the officer alleged. “Both parties continued to be uncooperative and refused to listen to any of my instructions.” When the second officer arrived and tried to assist Hamilton – “who was thrashing around in a nearby road side puddle” – Morgan allegedly began screaming that the officer was not allowed to speak to her. Morgan was allegedly unable to move and fell back on the street. Another vehicle drove onto the street and Morgan was requested to get up or be arrested. He was unable to move but allegedly kept screaming and was arrested. He allegedly kept thrashing while being cuffed so a resisting charge was added. Three officers attempted to assist Hamilton after she reportedly fell down in the puddle. She was pulled out of the puddle “multiple times,” but allegedly continued to “crawl and roll on the roadway.” She also allegedly attempted to splash the officers while screaming. After reportedly throwing her baseball cap at an officer, she was arrested. Hamilton allegedly pulled away while they were trying to cuff her, raised a leg, and struck one of the officers in the calf. Both were held without bail.
