Concord Man Arrested On Gun Threat Charges

CONCORD, NH — A former South End man is facing felony threat charges after being accused of pointing an AR-15-style rifle at a roommate during an argument about the cost of heat and rent.

Around 7 p.m. on Jan. 19, officers were sent to Peterson Circle to interview two complainants about a possible gun threat incident. One complainant said around 5 p.m., he was at his home on Pierce Street, in his room, when he heard yelling downstairs.

At first, he did not think anything of it and thought it was just an animated conversation between his other roommates. Moments later, one of the roommates, David Robert Bearor, “walked upstairs and began to yell at him” about the “price of rent and how much the heat costs,” according to a report.

The complainant opened his door and saw Bearor, wearing a ballistic vest and pointing a rifle at him, an affidavit said. The complainant went back into his bedroom and hid, in an attempt to create distance from Bearor. He said Bearor demanded he be shown how much it cost to live there and said he would kill them both, the affidavit said. The ranting continued for about 10 or 15 minutes until Bearor went into his bedroom, the report said.

At that point, the complainant ran downstairs, spoke to the other roommate, who was showering, about what happened, and suggested they leave. The complainant accused Bearor of “cocking his gun from the stairwell” while “coming at them,” the affidavit said.

During questioning, the complainant said he did not know if Bearor had a mental illness but, sometimes, he became “unhinged” over “mundane things,” the officer wrote. He described the rifle as a black AR-style rifle and said the vest had pockets for more ammunition, a flashlight, and other items.

The two roommates later left the home and called the police from another location.

The second roommate said she had been speaking with Bearor and told him she was going to turn up the heat before taking a shower and he “began to yell at her” about how much it costs to heat the house. She took her shower, hoping he would calm down, the report stated. A few minutes later, she heard her other roommate, banging on the door, stating Bearor had threatened to kill them again, the affidavit stated.

When asked what she meant by “again,” she said there was a previous incident, sometime in 2020, after she was searching for her phone at 5 a.m. while trying to go to work. Bearor, she said, was yelling at her for waking him up and later, “pointed a rifle at her,” the affidavit stated.

Five police officers and a sergeant then went to Pierce Street, created a perimeter, and called Bearor, asking him to come out of the house, which he did, the report stated. He “appeared confused” about why police were there but later, admitted to exchanging words with his female roommate about heating the home, the affidavit stated.

“David said that he never said anything that could be construed by someone as threatening,” the officer wrote. “David was so adamant that he never got into any type of argument with (his male roommate). David told me that (the complainant) exchanged pleasantries about the weather when he first got home from work.”

The reporting officer said Bearor gave written consent for the home to be searched and police found the rifle in an open safe. A ballistic vest, with several extra magazines, was found in the closet. The officer also reported finding several boxes of ammunition and a World War II-style Arisaka rifle. Bearor, the officer wrote, “would later revoke his consent” and police requested a search warrant.

A check of his criminal record found a conviction for pointing-brandishing a firearm in Rockingham Virginia District Court in July 2013. Bearor also had been convicted on a variety of charges in Hillsboro District Court including simple assault, violation of a protective order, and resisting arrest, the report stated.

Bearor, 38, was arrested on two felony counts of criminal threatening-deadly weapon.

During processing in Merrimack County Superior Court, two more criminal threatening-deadly weapon counts were added to his charges. He was held on preventive detention pending access to another living address.

On March 3, mail sent to him was returned, according to court records. A dispositional conference for jury selection was scheduled for Monday.
