Concord Man Spits At Cop After Drunken-Driving Arrest: Report

Cops: Sebastian Rainie crashed his car on Hazen Drive, dropped his pants during questioning, claimed to have COVID-19, spit on the officer.

CONCORD, NH — A Concord man was arrested and held without bail after a drunken-driving crash on Hazen Drive earlier this month.

Concord fire and rescue teams and police were sent to a crash just before midnight on Jan. 7. The reporting officer spoke to Sebastian Duncan Rainie, 31, of Avon Street in Concord who, according to an affidavit, admitted he was driving the vehicle before the crash.

During an interview, the officer accused Rainie of being impaired — acting "disorganized" and offering "bizarre behavior and statements." He accused him of "swaying" and being lethargic at times of hunching over and not standing steadily.

"At one point, he dropped his pants for no reason while standing in the middle of the road in his underwear," the officer stated.

Rainie refused medical treatment from EMTs and after being accused of being uncooperative during a field sobriety test, he was arrested.

While being transported to police headquarters for booking, Rainie was accused of yelling at the officer, claiming to have COVID-19, saying he tested positive earlier in the week. When the officer attempted to put a mask on him later, he spit at the officer, an affidavit said, hitting the officer in the hand-wrist area.

Rainie was charged with driving under the influence, speeding, simple assault, criminal threatening, and resisting arrest or detention charges as well as uninspected vehicle, yellow/solid line crossing, and number-plate violations. The officer accused Rainie of being difficult during booking so the police decided to send him directly to the county jail.

While being driven there, Rainie "stated he could not breathe," so the officer headed to Concord Hospital, the report said. After being evaluated, he refused to leave, the affidavit added.

"Sebastian went limp, refusing to comply with instructions, and required multiple people to physically place him in the wheelchair before being moved to the cruiser," the report said.

Eventually, he was put back in a cruiser and taken to the Merrimack County Jail.

Concord police said on Tuesday the officer was not physically injured during the incident.
