Homeless Man Racks Up Armed Robbery, Officer Assault Charges

Oscar Ndibanje has been arrested numerous times during the past three months, according to court documents.

CONCORD, NH — A local man has been arrested at least four times in the past three months including an accusation of armed robbery as well as reportedly assaulting officers during an alcohol arrest, according to Concord District Court documents. Oscar Ndibanje, 21, a homeless man now located in Concord, was arrested in late July on three counts of simple assault on a police officer, three counts of resisting arrest or detention, and three counts of unlawful possession of alcohol and a week later theft by unauthorized taking or transfer and unlawful possession of alcohol (he was 20 at the time). In August, he was arrested again on a bench warrant and for armed robbery, resisting arrest or detention, and default or breach of bail conditions after an alleged incident near the Yellow Submarine sub shop on North State Street.

Back in July, officers were called to the area of the TD Bank on North Main Street for a report of an intoxicated African-American man who had entered the bathroom of the Cumberland Farms on North Main Street. “The callers,” the reporting officer noted, “were concerned for the male’s welfare.”

The officer located Ndibanje in the bathroom and recognized him from previous contacts. He reportedly had two bags with him and he was “extremely unsteady on his feet,” and smelled like alcohol. On several occasions, the officer alleged, he “lost his balance and fell backwards against the wall.”

When asked how much alcohol he had consumed, he allegedly slurred a single word: “Vodka.”

Other officers arrived and attempted to take him into custody for unlawful internal possession. When they informed him that he was going to be arrested and began placing him in cuffs, he allegedly “began to fight with us,” physically tensing his muscles, and pulling his arms toward the front of his body, the officer alleged. They requested Ndibanje to stop resisting several times but he allegedly refused to obey the commands and was taken to the ground, the report stated.

“Ndibanje continued to pull his arms away from us and kick his legs,” the officer alleged, striking one of the officers in the left shin.

They eventually got him to his feet, according to the report, and tried to escort him to a cruiser but he allegedly refused to comply, yelled profanities, and refused to sit in the cruiser. They tried lifting his feet up from underneath him to get him into the vehicle but he allegedly pushed back. He also allegedly lowered his head in an effort to keep from getting into the cruiser.

Eventually, the officer noted, Ndibanje was put in the cruiser.

At this point, the officers realized that he hadn’t been searched for weapons so he was removed from the vehicle, patted down, and a folding utility knife was allegedly found in his pocket. They tried to get him back into the car, but he allegedly remained aggressive, uncooperative, and disobeyed commands, according to the report.

A fourth officer arrived at the scene and they were able to get him partially into the vehicle but Ndibanje “wedged himself against the middle divider in the rear seat and struck his left foot in the door jam to prevent us from pacing his leg inside of the vehicle and prevented us from closing the door.” During the struggle, an officer was kicked in the face by Ndibanje, the report alleged. The reporting officer was also allegedly kicked in the hand and was injured on another hand while it was pinned against a door while trying to get him into the cruiser.

After several minutes, the officers were able to get him into the cruiser.

During processing, Ndibanje allegedly yelled, “F--- you, b---- n----” at an officer. A search of his bags, according to the report, found two fifths of vodka – one unopened Grey Goose and an almost empty bottle of Svedka.

Ndibanje was charged and held.

According to the Concord Monitor, the armed robbery incident involved an alleged carjacking attempt – with Ndibanje reportedly threatening a driver by reaching into an open window with a knife after the driver had already agreed to give him a ride.
