Rochester Man Arrested On Statutory Rape And Computer Services Prohibited Charges In Concord

CONCORD, NH — A random police patrol of a recreation area in Concord led to a man from Rochester being arrested on statutory rape and computer services charges after being accused of sexually assaulting a teenage girl.
Around 10 p.m. on June 5, an officer patrolling the Sewalls Falls Recreation Area on Second Street came upon a parked white Dodge Ram pickup truck they thought was unoccupied. But on the second pass, the officer saw a light on inside the cab. The officer reported seeing a couple, who were topless, in the rear seat of the truck, according to a report. After exiting the police cruiser, the officer reported the couple appeared to be fully nude and scrambling to gather their clothes.
The man was identified as Jaythien Guillermo, 24, of Trinity Circle in Rochester, via a U.S. passport. The woman turned out to be a 15-year-old girl.

Another officer was requested to the scene and stood by while the vehicle was checked.
Police Interviews
Guillermo was interviewed by the first officer and, according to an affidavit, said he and the girl had been communicating on Snapchat for two or three months. He drove from Rochester to meet the girl, picking her up on Fisherville Road earlier in the evening, according to a report. Guillermo, a detective, wrote in an affidavit, admitted to having sex with the girl that evening and two or three times during the past several months. He was also accused of admitting there were videos of them on the Snapchat app on his cellphone and he shared them with the girl.

Guillermo admitted he lied to the girl, telling her he was 17 or 18, and said he thought she was 16 or 17, even though he acknowledged there were communications on Snapchat in which her true age was discussed, the affidavit stated.

The girl, who was in earshot of the interaction between Guillermo and the first officer, stated, “You said you were 17,” according to the report.
During an interview with the second officer, the girl said they had sex several times at the recreation area, the report stated. She also corroborated Guillermo’s statement that there were videos of their first encounter in their Snapchat thread, a detective wrote.
A third officer was requested to take the girl home.
After dropping her off with a parent, they agreed to “a minimal facts interview,” in which the girl confirmed they started communicating in March, she did not know he was 24, and she told him she was 15, the affidavit stated.
A consent search of the girl’s cell phone was also given to the police.
Evidence Search
An extraction was performed on the girl’s cellphone a few days later, according to a report.
A detective noted that the cellphone’s data corroborated much of the prior information provided to officers during the interviews.
The detective also confirmed the videos were recorded on April 9 and April 15.
A warrant was issued for Guillermo’s arrest on certain uses of computer services prohibited and three charges of felonious sexual assault of a victim aged 13 to 15, all felonies. He was arrested on June 12.
Guillermo was arraigned via video on Monday and entered no plea. He was also detained. A probable cause hearing is booked for June 25.
