Woman Accused Of Kicking Cop, Is Charged With Resisting, Trespass

CONCORD, NH — A Concord woman, after a driving under the influence arrest in April, was arrested again in May and June on various charges, accused of screaming at pharmacy employees and refusing to leave facilities in the city.

Devan Jean Jordan, 29, a homeless woman now located in Concord, was arrested on April 24 on driving under the influence and resisting arrest or detention after an incident on Fort Eddy Road.

About two weeks later, on May 8, officers were sent to Concord Hospital at just before 6 a.m. for a report of an unwanted guest. Dispatch told them there was a woman refusing to leave the hospital grounds after being told several times to leave by security.

After arriving, the officers learned the woman, Jordan, was discharged nearly three hours before, was medically cleared, and had to leave. Several times they told her she had to line up a ride or she had to leave the grounds by foot. Both Jordan and the officers attempted to reach family members to line her up a ride but were unsuccessful, according to an affidavit.

"After numerous attempts to tell Jordan to leave the property, she continued to refuse," the reporting officer stated.

A little while later, Jordan grabbed her belongings "slowly" and "after quite some time," made her way out of the ER entrance doors, the report stated. She walked to the edge of the ER parking lot and dropped her bags and refused to continue walking off the property, police said.

At this point, police had spent 50 minutes at the call and decided to arrest Jordan on a criminal trespass charge.

While attempting to cuff her, "Jordan began squirming around, not letting (us) place the handcuffs on her wrists," the officer wrote. After several times, police were able to get control of her, and added a resisting arrest charged to her docket. The officers later learned she was arrested on the DUI charge and a breach of bail charge was added, too. Jordan taken to the county jail and held without bail.

About a month later, Jordan was arrested again, this time, at the Rite Aid on South Street on June 9, after a store employee requested assistance with a woman who was screaming for about 45 minutes about a prescription that was called into another pharmacy.

The officers arrived at the store around 9:30 p.m. and found Jordan "extremely agitated" about issues with medication, the report said. The officer said Jordan had an "overall appearance" that was "disheveled," was "unable to remain still during conversations," would "ramble quickly about various topics," and appeared to be "under the influence of methamphetamine," the affidavit stated.

Police learned from the pharmacist that Jordan was looking for Suboxone that was called into a Manchester Rite Aid not the Concord store and they couldn't fill the script. Employees asked her three times to leave and she refused, they stated.

The reporting officer returned to Jordan who, at this point, appeared to have a "level of impairment" that made them think she "would be a danger to her own safety," the reporting officer stated. The officer stated Jordan began to bolt from the store and was asked to stop but refused, according to the affidavit. The officers caught up to her and she began to struggle with the officers and was assisted to the ground to be taken into custody.

Jordan, however, was accused of flailing, attempting to kick officers, and roll away from them, but landed a kick on a second officer.

"I ordered Jordan to stop resisting and she did not comply," the officer wrote.

A third officer arrived and Jordan was brought under control but when put into a cruiser, propped her leg on the frame of the car door, attempting to keep it open, the officer said. Two officers were able to move her leg and close the cruiser door, the affidavit stated.

Jordan was arrested on simple assault, criminal trespass, resisting arrest or detention, and breach of bail charges, and was transported directly to county.

Jordan has been arrested several times since 2015 including numerous drug possession charges, theft, and warrants.
