Start Date For David Creato Murder Trial To Be Set Monday

The trial of the Haddon Township man in the death of his 3-year-old son was originally scheduled to begin Oct. 3.

Haddon Township, NJ -- The start date in the murder trial for David Creato will be set on Monday, Oct. 3, the Philly Voice reports.

Monday was originally scheduled to be the start date for the trial, but the judge now says that will be a status conference to determine when the trial will begin, according to the report.

The reason for the change was unknown.

Creato is charged with murder in the death of his 3-year-old son, Brendan.

He was indicted on charges of first-degree murder and second-degree endangering the welfare of a child on Jan. 12.

The prosecution alleges David Creato killed his son because he was paranoid about losing his 17-year-old girlfriend, who was vocal about the fact she didn’t like children.

The prosecution has 9,478 text messages exchanged between the two, some of which include his girlfriend saying she would leave him because of the relationship between himself and his son.

Legal analysts have said motive is key, and that his state of mind could become a basis for the defense.

Brendan Creato was last seen at 8:15 p.m. on Oct. 12, 2015, when his grandmother dropped him off at his father’s house.

The following morning, David Creato reported his son missing, calling 911 and telling authorities, “I just woke up and my 3-year-old’s missing.”

A K-9 unit from the Delaware River Port Authority Police Department tracked the child to a wooded area off South Park Drive in Haddon Township, where he was found deceased shortly before 9 a.m., three hours after he was reported missing.

David Creato faces between 30 years and life in prison if convicted. He is currently incarcerated on $750,000 bail.
