Stop & Shop Loses Appeals Regarding OPRA Complaints
The decision goes back to an application by ShopRite to build a store on Greenwood Avenue, a Bergen County-owned road.

WYCKOFF, NJ — A three-judge panel has affirmed two appeals that were ruled against Shop & Shop, seemingly putting an end to the company's yearslong legal action against ShopRite and, most recently, the county Planning Board.
The Appellate Division panel Thursday affirmed the two previous Superior Court decisions regarding Shop & Shop Supermarket Co.'s challenge that the Bergen County Planning Board violated the Open Public Records Act.
Cindy Carrasquilla, a Shop & Shop spokesperson, did not respond to a request for comment by press time.

The ruling is the last appeal Shop & Shop filed in the matter, which dates back to 2010. The company has continually challenged ShopRite's parent company, Inserra Supermarkets, and its application to construct a 62,000-square-foot store in the Boulder Run shopping center on Greenwood Avenue, a county-owned road.
The Wyckoff Planning Board approved the application in February 2013 after more than 30 meetings on the matter, which began a series of appeals by Stop & Shop.

The Bergen County Planning Board also approved the plan in 2014. Stop & Shop filed 14 complaints regarding the decision, 11 of which were summarily dismissed.
A three-judge Superior Court appellate panel dismissed the final three counts in August.
Demolition work already took place at the future ShopRite location.
