Plea Deal In Baby-Killing Road Rage Incident
The driver's fury was directed at a taxi in traffic on Route 59, the Rockland County DA said.

A 63-year-old Spring Valley man has pleaded guilty to second-degree manslaughter for a road rage incidentthat killed a baby in a stroller on Route 59. Albert Gomez ran down a mother and her three children in June in a fit of fury directed at a taxi.
“The defendant has admitted his guilt and will be held accountable for causing the tragic death of a baby boy who had his entire life before him,” said Rockland County District Attorney Thomas P. Zugibe in the announcement.

- One count of Manslaughter in the Second Degree, a class "C" Felony
- One count of Criminally Negligent Homicide, a class "E" Felony
- Two counts of Assault in the Second Degree, class "D" Felonies
- One count of Assault in the Third Degree, a class "A" Misdemeanor
It was about 2:47 p.m. on June 26 when Gomez sped onto the shoulder of Route 59 in Spring Valley in his 1999 Toyota Corolla. He struck the 38-year-old woman, her two daughters, ages 13 and 9, and 3-month-old son as they walked along Route 59 near Robert Pitt Drive.
The infant, Mayer Braun, was being pushed in a stroller. He was thrown out of the stroller when it was hit. He succumbed to his injuries on July 5, 2017. His mother and older sisters also suffered serious, but non-life-threatening injuries and are recovering, Zugibe said.

Sentencing is scheduled for Feb. 6, 2018, at which time Gomez will receive 1 1/3 to four years in state prison, as part of the plea agreement. The defendant remains in custody in the Rockland County Jail, Zugibe said.
