A repair request has been made for the units. Corrective Actions: Ensure the units are holding at proper temperature to main TCS foods below 41F.
- Observed ROP fish thawed in the vacuum packaging. The facility voluntarily discarded the fish. A HACCP plan is required to vacuum package fish. Discontinue ROP fish until a HACCP plan is approved. Corrective Actions: Discard all previously vacuum packed fish. Submit a HACCP plan.

Obtain a Food Certification within 10 days.
- Observed pizza cutter soiled and not cleaned from yesterday. Corrective Actions: Clean and sanitize the food-contact surfaces of the pizza cutter every 4 hours and make sure to do it at the end of day before closing.
- Observed cheesecake (47F) and velvet cake (47F) in 2-sliding glass dr ref. at improper cold holding temperature. The employee relocated the cakes into the walk-in ref. Corrective Actions: Relocate food to a refrigeration unit that is capable of maintaining food storage at 41°F or below.
- Observed pizza-dough trays stored on the floor. Corrective Actions: Keep pizza-dough trays off the floor and store them on the shelves or dunnage racks.

- Cut lettuce stacked too high in the cook's right prep refrigerator found at 49 F. Half 'n' half found in server station refrigerator at 47 F. Corrective Actions: Lettuce storage altered to be below the pan fill line and covered. Units adjusted to colder settings to keep foods at or below 41 F.
- Flies observed in the facility. Corrective Actions: Eliminate pests from the facility.

- During inspection observed containers and sponges in the front handsink, and in the kitchen handsink. Corrective Actions: Handsinks must be used for handwashing only. Do not store or place items in the handsinks, or use handsink to wash dishes or utensils.
- During inspection observed raw shrimp stacked on top of a container of thai basil in the top of the prep table. Corrective Actions: Do not store raw foods over ready to eat foods, like produce. Shrimp was moved and basil was discarded by PIC.
- Observed that cooked tempura shrimp was stored above the containers on the prep table top at 63F. Observed beef stored on the countertop at 83F. Observed raw chicken that had been recently purchase was placed outside of the walk in cooler, and was holding at 55F. Corrective Actions: TCS foods must be held at 41F or below. Do not store TCS foods above the inserts in the prep tables, and do not leave food on the countertop for extended periods. PIC voluntarily discarded foods, and chicken was moved to the walk in cooler.
- Observed that establishment is using time as a public health control for rice, but does not have a written policy, and is not labeling the rice with the time prepared, or the time to discard. Corrective Actions: If time only, rather than time in accordance with temperature control, up to a maximum of 4 hours is used as the public health control : 1) the food shall have an initial temperature of 41°F or less if removed from cold holding temperature or food shall have an initial temperature of 135°F or above if removed from hot holding temperature control, 3) the food shall be marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control 4) the food shall be cooked and served, served if ready to eat, or discarded within 4 hours from the point in time when the food is removed from temperature control, and 5) the food if unmarked or marked to exceed a 4 hour limit shall be discarded. 6) The establishment must have a written policy that includes the food that will use time as a public health control.
- During inspection observed that foods were left at room temperature to thaw, and fish in vacuum packaging were not opened prior to thawing, as directed on the package. Corrective Actions: Foods must be thawed in a cooler, or submerged under cool running water. Do not thaw items for extended periods under ambient temperatures. PIC moved items to cooler.
- Observed that papaya was sliced at 3 compartment sink, soiled dishes has not been moved or cleared from prep area. Corrective Actions: Food must be protected from contamination during preparation. The 3 compartment sink may be used for food preparation, only if the sink area has been cleared of all soiled dishes, and sink area and drainboards have been fully washed rinsed and sanitized, before using for food preparation. After food prep, area must be washed and sanitized before using for washing dishes and equipment.
- Observed ice cream scoop stored in standing water at ice cream station, rice scoop in sushi rice with handle in contact with the rice, and bowl used as scoop for rice in the cooler. Corrective Actions: Utensils must be stored in a clean dry area, with handle out of the food. Do not store utensils in water, unless water is 135F.
- During inspection observed foil and cling wrap covering shelves in kitchen. Corrective Actions: Do not use single use items or materials on equipment. Non food contact surfaces including shelving should be constructed or maintained to be smooth and easily cleanable.
- During inspection observed that the 3 compartment sink was not sealed to the wall. Caulking / sealant is separating from wall. Corrective Actions: Nonmovable equipment must be sealed to the wall to prevent and drips or splashes behind equipment.

What Violations Do ACPHD Inspectors Report?
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.
For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection. Depending on the results of the inspection, the health department can pursue several actions.
They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the food service presents a substantial and imminent threat to the public health."
