Fairfax Man Charged In Fair Oaks Shooting Near Legato: Updated
A suspected armed shooter is in custody after a man on an e-bike was shot Thursday night in the Fair Oaks area, authorities say.

FAIR OAKS, VA — A Fairfax man was arrested after a shooting Thursday evening near Legato left another man hospitalized, Fairfax County police said.
Officers responded at 5:28 p.m. Thursday to the 12300 block of W. Ox Road after a report of a shooting. Police said they found an adult male victim with gunshot wounds to his upper body.
The victim was taken to a hospital with injuries initially considered life-threatening. Police said his condition was later downgraded to stable.

Detectives with the Fairfax County Police Department’s Major Crimes Bureau said preliminary information showed the victim had been riding a motorized bike when the driver of a car stopped and got out. After a brief verbal exchange, police said, the driver produced a firearm, fired into the air and then shot the victim.
The shooter left the area in a Toyota Camry before officers arrived, police said.

Responding officers saturated the area and obtained the suspect vehicle’s license plate number. Shortly afterward, the department’s Real Time Crime Center received an alert from a Flock license plate reader and notified the Sully District Neighborhood Patrol Unit.
Police said officers found the vehicle in Centreville. With help from the Fugitive Tracking and Apprehension Team, officers conducted a coordinated traffic stop and arrested Milad Attai, 26, of Fairfax.
Attai was taken to the Fairfax County Adult Detention Center and charged with malicious wounding, reckless discharge and use of a firearm in the commission of a felony. He was being held without bond, police said.
Attai was arraigned Friday morning in Fairfax County General District Court and a preliminary hearing was scheduled for 2 p.m. on Aug. 10, according to court records.
While all three charges Attai is facing are felonies, the most serious is malicious wounding, which is a Class 3 felony. If convicted on this charge, he faces a possible sentence of five to 20 years in prison and fines of up to $20,000, under Virginia law.
Attai was arrested Dec. 22, 2025 in the Town of Vienna, and was charged with brandishing a weapon and simple assault, which are Class 1 misdemeanors, according to court documents. On Feb. 9, he was found not guilt on both of the charges in Fairfax County General District Court.

Victim specialists from the Major Crimes Bureau’s Victim Services Division have been assigned to help the victim receive resources and assistance.
