Vienna Crime: Fight in Local Parking Lot Over Right of Way in Drive Thru
The week in crime in the Town of Vienna, from the Town of Vienna Police Department weekly crime report.

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from August 28, 2015 – September 03, 2015. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

INCIDENTS:
Assault 15-008368 Wells Fargo Bank 212 Maple Avenue, East August 29 12:30 p.m. A drive thru customer reported he and another customer became involved in a verbal argument concerning who had the right of way in the parking lot. The argument escalated when the customers exited their vehicles and one pushed the other and the two tussled briefly.

One of the customers left prior to the arrival of the police. He soon returned and apologized to the other customer.
Both individuals were advised of the warrant process should they wish to pursue charges. The apology settled their disagreement and they left without further incident.
Suspicious Event 15-008297 Vienna Baptist Church 541 Marshall Road, SW Between August 01 at 12:00 p.m. and August 27 at 5:00 p.m. An employee reported the parents of two prospective students had been harassing school employees after being told there was not enough space to enroll both their children. The parents were also informed the deposit they had paid was non-refundable.
Sgt. Sheeran informed the employee the refund of the deposit is a civil matter. The employee was informed to contact the police department if the harassing telephone calls continue.
Petit Larceny 15-008287 900 Block Carole Court, SE August 24 8:00 a.m. An elderly resident reported she went out for a bicycle ride and when she returned her checkbook and a bottle of medication had gone missing. She stated she believed someone may have entered her home and took the items. There were no signs of forced entry.
Arrest – Driving While Intoxicated/Refusal 15-008282 1100 Block Maple Avenue, NE August 27 11:29 p.m. Sgt. Elias was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment. After failing to complete a series of field sobriety tests he was arrested for Driving While Intoxicated.
The 22 year old man from Spring Gate Drive in Mclean, Virginia was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After refusing to provide the sample he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated and Refusal to Submit to a Breath Test.
Civil Matter 15-008366 1100 Block Fairfway Drive, NE August 28 between 8:00 a.m. and 10:00 p.m. A citizen reported he and his sister had been involved in a disagreement as to the proper disposal of sewer pipes that were excavated from their mother’s residence.
The sister stated she thought the pipes were a bio-hazard and were to be removed by the contractor. The brother felt he was entitled to the pipes. He stated he would follow up with the contractor.
Civil Matter 15-008295 1100 Block Fairway Drive, NE August 28 10:20 a.m. MPO Smith responded to the area after receiving a report of people yelling. Upon his arrival he encountered two individuals, a sister and her brother-in-law, involved in a heated argument.
The sister stated the argument stemmed from her brothers interference with the inspection of a water/sewer line being installed at their mother’s home.
The brother-in-law agreed to cease his interference in the matter.
Suspicious Event 15-008316 Eye Level Learning Center 513 Maple Avenue, West August 28 5:50 p.m. A citizen responded to the Vienna Police Station to report that as she was dropping her son off at the Eye Level Learning Center she noticed a white male in a white four door sedan who appeared to be staring at her. She stated when the vehicle appeared to be pulling out of the parking lot she walked her son to the Learning Center. When she returned the driver had only moved to a different parking space.
She stated he then moved his vehicle next to hers and began honking his horn at her. She exited the parking lot and observed the driver following her as far as Center Street.
Officers checked the area but were unable to locate the vehicle.
Vandalism 15-008367 Cupcakes! 527 Maple Avenue, West Between August 28 at 6:30 p.m. and August 29 at 9:30 a.m. An employee reported she arrived at work and discovered a small section of the front window had been smashed.
Arrest – Drunk in Public 15-008335 400 Block Mashie Drive, SE August 28 11:29 p.m. A resident reported an unknown man had entered her home through the back door. After entering the home he went back outside and sat down on her back porch.
Officer Selbonick responded and located the individual still sitting on the chair on the resident’s back porch. After speaking with the individual he determined he was extremely intoxicated.
Officer Slebonick arrested the 51 year old man from Lagrange Street in Lorton, Virginia for Drunk in Public. He was transported to the Fairfax County Adult Detention Center where a nurse determined he was in need of medical treatment.
The man was transported to an area hospital for treatment. After the treatment he was returned to the Fairfax County Adult Detention Center where he was to be held until he was sober.
Domestic Dispute 15-008336 Patrick Street, SE August 28 11:32 p.m. A resident reported she and her boyfriend had been involved in a verbal argument.
MPO Vazquez responded and after speaking with both parties the boyfriend agreed to go to bed for the night and cease arguing.
Domestic Dispute 15-008361 200 Block Tapawingo Road, SW August 29 10:14 a.m. A resident reported that she and the father of her children had been involved in a verbal argument. She stated he became angry when he could not find his car keys.
Officer Herrera responded and spoke with both parties who agreed the argument had not turned physical. The resident provided him with a spare key allowing him to leave without further argument.
Arrest – Domestic Assault 15-008403 Colin Lane, NW August 30 1:25 a.m. MPO Shaw responded to the area for the report of a domestic assault that had occurred. After speaking with both individuals he determined the boyfriend had struck his girlfriend. MPO Shaw arrested the 23 year old man from Colin Lane, NW in Vienna for Domestic Assault.
He was transported to the Fairfax County Adult Detention Center where he was charged with Domestic Assault. A 72 hour Emergency Protective Order was also issued. He was informed he would be arrested if he violated the order.
He was released on his signature and transported back to his residence.
Suspicious Event 15-008401 1100 Block Lakewood Drive, SW August 30 1:30 a.m. A resident reported she and her husband heard a loud thud in their backyard. The residents went to the backyard to investigate but did not see anyone. The wife stated she had seen two brothers in the neighbor’s yard on previous occasions. She thought they may have caused the noise
She requested extra patrols in the area.
Arrest – Violation of Protective Order 15-008416 Colin Lane, NW August 30 12:22 p.m.
Officer Herrera responded to a residence after the girlfriend of the resident reported he had taken her car without her permission. The boyfriend had been arrested earlier in the evening for Domestic Assault and a 72 hour Emergency Protective Order had been issued (See Case 15- 008403).
The girlfriend was informed by her sister the boyfriend had dropped off her vehicle at the 7-11, located at 537 Maple Avenue, West. After retrieving her vehicle, Officer Herrera escorted the girlfriend back to the residence to retrieve her personal belongings. When they arrived he discovered her boyfriend was in the residence in violation of the Emergency Protective Order.
The boyfriend was transported back to the Fairfax County Adult Detention Center where he was charged with Violation of a Protective Order. He was held on an $80,000.00 bond.
Missing Adult 15-008417 400 Block Ridge Road, SW August 30 1:04 p.m. A resident reported his elderly mother had wandered from her home. Sgt. Sheeran responded to the area and located the woman and reunited her with her son.
The son was provided with information about the Safe Return Program.
Suspicious Person 15-008542 7-11 545 Maple Avenue, West August 30 3:45 p.m. MPO Smith was on patrol when he located a vehicle that had been reported stolen. Near the vehicle he observed four men standing. MPO Smith spoke with the individuals and determined they were not involved with the stolen vehicle.
Domestic Dispute 15-008425 Ayr Hill Avenue, NE August 31 1:19 a.m. A resident reported that he and his son had been involved in a verbal argument after the parents had shut off his internet access.
Officer Slebonick responded and spoke with both the father and son. Both gave similar accounts of the incident to include stating the argument had not turned physical.
The son agreed to go to his room for the rest of the evening to allow everyone to calm down.
Medical Case 15-008435 100 Block Park Street, NE August 31 1:36 p.m. A resident reported that her daughter was distraught and needed medical attention.
Officer Hylinski responded and after speaking with the daughter was able to convince her to be transported to an area hospital for treatment.
Suspicious Person 15-008459 Sherwin Williams Paint Store 120 Branch Road, SE September 01 11:00 a.m. An employee reported an ex-employee had returned to the store and was acting suspicious. He stated he would like to have the ex-employee trespassed from the business.
Officer Hylinski informed the employee to contact the police department if the ex-employee returned and he would be formally trespassed.
Suspicious Event 15-008473 Giant Food Store 359 Maple Avenue, East September 01 7:43 p.m. An employee reported customers were in the store purchasing food with Food Stamps. He stated he believed the purchases were fraudulent.
Officer Post responded and spoke to one of the customers and based on her conversation there was no evidence a crime had been committed.
Medical Case 15-008474 Kinglsey Road, SE September 01 9:11 p.m. A resident reported her husband and son had been in a verbal argument and she was afraid her son may harm himself.
Officer Post responded and after speaking with the son she convinced him to be transported to an area hospital for treatment.
Suspicious Event 15-008489 Vienna Community Center 120 Cherry Street, SE September 02 9:30 a.m. An employee was approached by two individuals who were inquiring about another employee. The individuals then informed the employee to advise the other employee to “Watch his back”.
He stated the individuals may friends of his estranged wife.
Larceny 15-008533 200 Block Cedar Lane, SE September 02 between 12:00 p.m. and 1:00 p.m. A citizen responded to the Vienna Police Station to report he parked his unlocked vehicle in front of the McDonalds and left the engine running while he went into the restaurant. He stated when he returned someone entered his vehicle and had taken his briefcase containing personal papers.
Assault 15-008495 Fairway Drive at Old Courthouse Road, NE September 02 12:41 p.m. A resident reported he was jogging in the area and as he passed an elderly gentleman the gentlemen turned and struck him on the arm.
Officer Tremont responded to the area and recognized the description given of the elderly gentlemen. He responded to his residence and spoke with his wife who informed him her husband suffers from a medical condition.
The resident was contacted and declined to pursue the case.
Police Service 15-008502 1000 Block Mountfort Court, SW September 02 3:28 p.m. A resident responded to the Vienna Police Station to turn in unused/unwanted ammunition for destruction.
Missing Adult 15-008529 300 Block Old Courthouse Road, NE September 03 10:36 a.m. A resident reported her elderly husband had wandered away from the house and she had not been able to find him.
Officer Tremont was responding to the area and observed the gentleman waking on Fairway Drive towards his home. The wife responded to the area and assisted her husband in walking the rest of the way home.
The wife was informed of programs she could use to assist with her husband.
Assist EMS 15-008536 100 Block Patrick Street, SE September 03 2:37 p.m. A resident’s father reported his son may have been intending to harm himself and requested an officer check on his welfare.
MPO Smith responded and spoke with the resident who stated he was not going to harm himself. He did, however, have an injury to his arm that required medical treatment.
Fairfax County Fire and Rescue personnel responded and transported him to an area hospital for treatment of the injury.
Open Door 15-008539 1100 Block Lakewood Drive, SW September 03 4:24 p.m. A resident reported two individuals had entered a neighboring home that is vacant.
MPO Smith responded and located an open door. The interior was checked and no one was found and nothing appeared out of place. The residence was secured prior to leaving.
Arrest – Petit Larceny 15-008540 Giant Food Store 359 Maple Avenue, East September 03 4:43 p.m. An employee stated a young man entered the store and absconded with a shopping basket and a bunch of junk food.
Lt. Taylor and Officer Tremont responded to the area and located the man who had taken the items at the rear of the Wendy’s at 411 Maple Avenue, East.
Officer Tremont issued a summons to the 19 year old man from Orrin Street, SE in Vienna for Petit Larceny. He was released after signing the summons.
