NEW CANAAN, CT — The state is asking an appellate court to deny a request by Michelle Troconis to have the conditions of her release relaxed in the Jennifer Farber Dulos disappearance case.

In a motion filed Monday, Senior Assistant State's Attorney Ronald Weller argues that a similar motion for modification was not yet heard due to Gov. Ned Lamont suspending court appearances because of the coronavirus pandemic.

Essentially, that hearing should be heard before a new one, Weller argues, and Troconis' next court hearing already is scheduled for Aug. 6. News 12 Connecticut's Marissa Alter posted Weller's brief on her Twitter page.

Troconis, the former girlfriend of the late Fotis Dulos, has been charged with conspiracy to commit murder in the case. She and Kent Mawhinney, an attorney and former friend of Fotis', are accused of helping Fotis Dulos murder Jennifer Dulos, his estranged wife, in May 2019. Fotis Dulos, was charged with murder and kidnapping, but he committed suicide in January before he could stand trial.

Weller argues that the motion filed by Troconis' attorney, Jon Schoenhorn, is seeking to have all non-financial aspects of her release lifted, including the removal of the GPS monitoring device she has been wearing on her ankle for more than a year. But the appellate court does not have the authority to do that, Weller says.

When the court will render a decision on the motion was not immediately known. Troconis remains free on bond but under house arrest. Mawhinney, who is next due in court on Sept. 3 remains in custody.
