STAMFORD, CT — Evidence seized by state police from Michelle Troconis' cell phone cannot be used against her in next month's trial concerning the disappearance of Jennifer Farber Dulos, a judge ruled Tuesday, the Stamford Advocate and News 12 Connecticut reported.

The cell phone was seized during a search a few days after Jennifer Dulos' May 24, 2019, disappearance, but at the time, state police reportedly only had a warrant to get a DNA sample from Troconis, not the phone.

Troconis was the girlfriend of the late Fotis Dulos, the estranged husband of Jennifer Dulos. The Duloses were in the midst of a contentious divorce and child custody fight at the time of her disappearance; she has not been found and is presumed to be dead.

Attorney Jon Schoenhorn, who represents Troconis, successfully convinced Superior Court Judge Kevin Randolph that a warrant would have been necessary to seize the phone, one of a host of motions to suppress various evidence that Schoenhorn has filed on Troconis' behalf.

Troconis is charged with conspiracy to commit murder and related violations in the case, and she is slated to stand trial beginning on Jan. 8. She is one of two surviving defendants in the case, the other being former attorney Kent Mawhinney, a former friend of Fotis Dulos.

In January 2020, Fotis Dulos died following a suicide attempt. He was facing kidnapping and murder charges in the case, but died before he could stand trial.

Mawhinney and Troconis are accused of assisting Fotis Dulos in the murder plot and cover up, and both have pleaded not guilty.
