PLYMOUTH, MA — Duxbury mom Lindsay Clancy's attorney filed an emergency motion in her triple murder case, according to reports.
"Lindsay Clancy's defense attorney, Kevin Reddington, has filed an emergency motion requesting for the court to stop holding sidebars on any subsequent proceedings and instead handle all matters in open court," CBS reported.
"The motion comes after a stunning day in court Thursday where the jury's foreperson told the judge a single juror won't follow the court's instructions about reasonable doubt," according to NBC.
That juror reportedly may face additional scrutiny.
"Lindsay Clancy's defense attorney said he expects the judge overseeing her murder trial to hold an additional inquiry Friday into the lone juror allegedly holding up deliberations," a Boston.com story said.
The prospect of a mistrial looms over the proceedings, as the jury has informed the judge three times that they cannot come to a unanimous decision.
"Reddington told reporters he wants to avoid a mistrial," CBS reported. Prosecutors want the jury to keep deliberating, even though they've said twice this week that they're deadlocked.
Clancy, 36, is charged with the January 2023 murders of 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.
"Prosecutors have said that in January 2023, Clancy intentionally strangled the three children with fitness bands in their Massachusetts home before jumping out of a second-floor window," the BBC reported. "Clancy, now 36, was paralysed by the jump and has attended the trial in a wheelchair."
"Clancy has admitted that she killed her children in 2023. However, her attorney, Kevin Reddington, claims her mental state was so impaired by postpartum mental illness that she shouldn't be held criminally responsible for their deaths," according to WBUR.
