Homeless Man Arrested On Imprisonment, Assault, Other Charges

Mark Kibbee of Concord was arrested after allegedly head-butting a cop during an investigation of an incident on Garvins Falls Road.

CONCORD, NH — A local man, with previous run-ins with the law, faces more charges after an alleged domestic incident in the southeastern part of the city recently. Mark Kibbee, 34, a homeless man now located in Concord, was arrested on Dec. 6, 2017, and charged with simple assault, domestic violence-simple assault, false imprisonment, domestic violence-false imprisonment, resisting arrest or detention, and simple assault on a police officer. At just after 10 p.m. on the date in question, police received a tip about a fight between a man and a woman near a dumpster outside of the apartment complex on Garvins Falls Road.

The witness stated that a man named Mark allegedly pulled a woman off a bicycle near the dumpster of the building and started slapping her around, according to an affidavit.

The reporting officer didn’t see anyone fighting near the dumpster and pulled around to the rear of the building. On the other side, the officer saw “several males” including one he knew from previous contacts – Kibbee – who reportedly was bleeding from the nose and had lips covered in blood, the affidavit noted.

“Kibbee appeared to be intoxicated,” the officer alleged. “As I approached Kibbee, I noticed that he had a small folding utility knife in one of the pockets on his jeans.”

The officer asked Kibbee what happened and he reportedly stated he had been punched in the face. He then allegedly “lunged forward” toward the officer’s direction “in an aggressive manner.” Knowing that he was armed, Kibbee was placed in handcuffs by officers, for safety reasons.

As other officers arrived, Kibbee allegedly “remained highly uncooperative and hostile,” and kept acting out and yelling at police who were trying to calm him down. At one point, he allegedly spit blood at one of the officers. The reporting officer went to get a spit mask as Concord Fire and Rescue teams evaluated Kibbee.

After the evaluation, with Kibbee allegedly remaining aggressive and hostile, officers attempted to escort him to a seated position to talk and pulled away from the grasp of one of the officers while they moved him. During this process, he allegedly began kicking at the officers and “violently whipped his head backwards” at the reporting officer.

“When Kibbee did this, the back of his head struck my right eyebrow/right cheek bone area,” the officer alleged. “I immediately felt the impact of Kibbee striking my head with his head.”

Kibbee was placed inside a cruiser – where he allegedly kicked and slammed his body into the partition of the cruiser – and was taken the Merrimack County House of Corrections after officers learned there was a no bail warrant arrest out of superior court for non-appearance in court.

A second officer conducted interviews at the scene, the report noted, including the initial caller, who alleged that Kibbee was “on top of a woman, pinning her against the ground underneath the staircase at the rear of building.” The witness alleged hearing the woman scream, “Stop hitting me, Mark!”

The second officer also contacted the victim who had blood on her lip and reportedly confirmed that she and Kibbee had been arguing but denied any physical assault after learning that he was arrested, according to the affidavit.

During the past few years, Kibbee, a former resident of Concord, Franklin, and Pembroke, has racked up a number of charges, including being picked up on warrants.

Last year, he was charged with burglary, simple assault, disorderly conduct, and two counts of criminal mischief-vandalism. He was arrested after an alleged incident in an apartment on Manchester Street.

In September 2015, he charged with simple assault, domestic violence-simple assault, false imprisonment, criminal threatening, and domestic violence-false imprisonment, after allegedly assaulting a woman in the parking lot of the Market Basket on Storrs Street.

In October 2013, he was charged with simple assault and false imprisonment after allegedly head-butting a woman at the Morning Star Apartments on Loudon Road.

In March 2013, he was arrested after a domestic disturbance on Wall Street and charged with two counts of simple assault-personal weapons, criminal mischief-vandalism, reckless conduct; place another in danger, and resisting arrest or detention.

A criminal mischief charge was issued against Kibbee in September 2011, after an incident with a broken table on Warren Street.
