The reporting officer noted that Davis – the male party – and the victim were “well-known in Concord and have a history of domestic violence.”

When they arrived, they spoke with an employee who alleged hearing a woman screaming, “Let me go, Let me go,” in the parking lot. He went out to investigate and then called police. When he went outside, the employee allegedly saw a man with his hands around a woman’s neck attempting to force her into a van.

“He was being loud and argumentative,” the employee alleged, adding that he heard things slamming and it appeared as if he was managing to “keep her in the van.”

The reporting officer went to speak to the victim but didn’t see Davis but he then appeared from behind the vehicle, shirtless.

The officer spoke to Davis who alleged that he and the woman began fighting earlier in the morning on Loudon Road about her smoking too much spice, according to a court affidavit. She got angry and told him to get out of the van. He reportedly stated that he refused and they continued to argue.

Davis reportedly stated that they began bickering about a necklace she was wearing and he agreed to leave the van if she gave him the necklace. She refused and when he went to grab for it, she bit his finger. She then drove to McDonald’s.

According to Davis, they have an agreement that they will stop fighting when one person offers the other a hug. He reportedly tried to offer her a hug and she refused and left the van and he started chasing her. Davis allegedly denied that their incident was physical, according to the report.

The officer spoke to the victim who alleged that Davis grabbed the necklace and broke the clasp. She alleged that he grabbed her shirt and ripped it – while showing the officer where it was ripped – and then attempted to choke her.

“(The victim) stated she could not breath,” the officer reported, adding that she didn’t appear to have any neck bruising and also admitted to past breathing problems. “(She) stated while being choked, Davis bit her face. I did observe what appeared to be fresh teeth marks on (her) right cheek.”

The victim stated that she again bit his finger and “got away from him,” running down street. But Davis chased her, caught her, gave her “a bear hug,” and attempted to drag her back into the van, she alleged.

Davis was determined to be the aggressor and was arrested and held on $4,000 cash bail. After refusing the bail, Davis allegedly turned to the bail commissioner and stated to her, “Beat feet,” and then, “F--- you.” After she left, he allegedly looked at the reporting officer and stated, “F--- you,” again, and said that everyone was “out to get him.”
